OK, Oyong, here's the complete section d of the U.S.C. paragraph you cited:

(d)It shall be unlawful for any person to sell or otherwise dispose of any
firearm or ammunition to any person knowing or having reasonable cause to
believe that such person—
(1)
is under indictment for, or has been convicted in any court of, a crime
punishable by imprisonment for a term exceeding one year;
(2)
is a fugitive from justice;
(3)
is an unlawful user of or addicted to any controlled substance (as defined
in section 102 of the Controlled Substances Act (21 U.S.C. 802
<https://www.law.cornell.edu/uscode/text/21/802>));
(4)
has been adjudicated as a mental defective or has been committed to any
mental institution;
(5)who, being an alien—
(A)
is illegally or unlawfully in the United States; or
(B)
except as provided in subsection (y)(2), has been admitted to the United
States under a nonimmigrant visa (as that term is defined in section
101(a)(26) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(26)
<https://www.law.cornell.edu/uscode/text/8/lii:usc:t:8:s:1101:a:26>));
(6)
who [2] <https://www.law.cornell.edu/uscode/text/18/922#fn002067> has been
discharged from the Armed Forces under dishonorable conditions;
(7)
who, having been a citizen of the United States, has renounced his
citizenship;
(8)is subject to a court order that restrains such person from harassing,
stalking, or threatening an intimate partner of such person or child of
such intimate partner or person, or engaging in other conduct that would
place an intimate partner in reasonable fear of bodily injury to the
partner or child, except that this paragraph shall only apply to a court
order that—
1. Please note that the mental defectives have to have been adjudicated
(found in a court proceeding) as a mental defective or committed to any
mental institution. A mere suspicion of mental problems does not bar
anyone from buying guns. Also, in the case of the Connecticut murderer of
1st graders, it was the mother who had bought the guns. The son - the mass
murderer - murdered the mother and proceeded to slaughter 1st graders.
Parents of mental cases must not be allowed to buy assault weapons. The
great mass of crazy and violent patients of psychiatrists have never been
committed to mental institutions or have been adjudicated as mental
defectives.
The new gun reform law that Congress passes must fill these loopholes.
New laws are needed to correct deficiencies in existing law. So your
argument that there are already laws on the books and those must merely be
applied by law enforcement officials is mentally dishonest. The NRA is
guilty of mental dishonesty and you, by parroting NRA arguments, are a
purveyor of NRA falsehoods and half-truths.
2. There is nothing in the law that says those in no-fly lists or are under
surveillance by the FBI are prohibited from buying guns.
3. There is nothing in existing law that prohibits the sale of guns to
those who have not been convicted of violent crimes.
4. There is no ban of sale of assault weapons (weapons of war) to private
individuals by either other private individuals or by duly licensed sellers
and manufacturers.
5. There is nothing in the law that says gun manufacturers must offer smart
guns. In fact, gun manufacturers have actually punished retail store
owners who insist on selling smart guns.
