I agree, confiscate it, give it back to the parent the first time. But, given that this is a public school, this may be a rampant problem and they may not have the manpower to keep up with the punishment schedule.
You're also relying on there being "involved parents". I may be biased, but there weren't a lot of "involved parents" in my child's first year in public school.
