The SCOTUS ruled that marriage is a basic fundamental right... Where the constitutional issue comes into play is that by denying gay marriages, you are violating people's 1st amendment rights and violating the 5th Amendment's Equal Protection clause. That was highlighted in this where this woman was taxed when her legal spouse died...had she been in a heterosexual marriage, this tax would not have been applied.
