Ok, to clarify this to Brian let's break down "Unsolicited Commercial Email" (aka Spam)

Unsolicited:  I never asked for any emails from you, I've judiciously turned off the 
"do not wish to receive partner emails" on EVERY site I've visited, I don't see any 
implied consent anywhere, so in short, your email is unsolicited

Commercial: You are not a friend of mine, or a work related contact email emailing me, 
you are not anyone that I know, or any email list I've opted into, you are promoting a 
business, and therefore you are commercial

Email: Well duh....

Therefore, I'd consider it Spam, and you'd better take me off the list, especially 
granted that this is my work email and there I look on Spam very nastily (having gone 
so far as to place phone calls with higher ups on particularly annoying spammers).  
Plus this is the City of LA as my ISP, you really want a bill from them? So Spam at 
your Peril.  In short, find another way....
