Jeff, You can download the file, but legally you are only authorized to use it if your switch was purchased with the enhanced software, or if you purchase the upgrade.
Cisco does watch who downloads which software, and checks it against what the downloading user is entitled to. If it doesn't match up, you might get contacted about the download, especially if you get each new version as it comes out.
