I don't think having a preference that essentially states "I am a blathering idiot and you know better than me. When I mute my sound I don't really want to mute my sound." is a good option to have. It seems like poor design. Also, remember that we're not just talking about the audio coming from the application, we're talking about all audio on the system. What if I was rocking out to iTunes, muted it to take a phone call in the next room, and your app decided it just had to alert me of its divine presence?
