As was hiding the nav mine.. :)
I understand where you are coming from. 
You have to program it right. It has to work with the fluid movement of your 
user,
so it must appear when there has been no touch for a period of time.

There is also the factor of having it slide in quickly or fad in gradually.
But basically making it like the nav on safari browser for iphone 
(where I am getting my idea from)
