INDIA----new death sentences

Death sentence for murderer

A Patiala House court on Friday pronounced death sentence on a murder
accused, terming the crime he had committed 4 years ago as the "rarest of
rare" cases.

The order for death by the gallows came even as the row over whether death
penalty should be awarded (sparked off by the recent execution of
Dhananjoy Chatterjee in Kolkata) has yet to settle.

Accused Brij Kishore alias Bittu had stabbed his victim, Madan Mohan Lal
Verma, 23 times, leaving him to bleed to death in south Delhis Sukhdev
Vihar. What made his crime the rarest of rare was that he stabbed his
victim repeatedly, when "1 or 2" jabs would have been enough to cause
death, the court stated.

Spelling out the order, additional sessions judge Lal Singh stated: If the
act of the convict is visualised, it has been extremely brutal, gruesome,
callous with full determination in order to leave no chance of reviving
the deceased.

Kishore was enraged with the deceased Madan Mohan Lal Verma for removing
an unauthorised construction belonging to his father, which had come up in
a park in Sukhdev Vihar. Victim Verma was secretary of Sukhdev Vihar House
Building Co-operative Society and Sukhdev Vihar Welfare Association. He
had moved a PIL in the high court against the illegal construction that
had led to its demolition. While pleading for a liniency, the defence
lawyer submitted that Kishore was a first-time offender and was only 19
years old when he committed the crime. Moreover, he was the sole bread
winner for his family, he said.

However, the prosecution contended that he was not entitled to leniency
considering the facts and circumstances of this case.

"One or two stab wounds were sufficient to cause death in ordinary course
of nature. But, the convict continued stabbing the victim with the knife,
repeatedly, with the same strength. The act of the convict demonstrated
his state of mind to be so cruel to mankind...," the judge stated.

Person given death sentence for killing own children:

A court in Kalyan today sentenced to death a 36-year-old man on the charge
of killing his three children by poisoning them.

Additional Session Judge Ashok Kadhalak found Naseer Ahmed Moin Khan alias
Mohammed Naseer Mouiddin, resident of Kalyan, guilty of charges and held
that it was rarest of rare case which deserves capital punishment.

The prosecution said the accused was married to Hafiza, who was already
married and had a 17 year-old-daughter.

The accused wanted to marry the daughter of Hafiza also and went on
pressuring for the same. As a result of which both mother and daughter got
fed up and left the house.

The annoyed accused hatched a conspiracy and picked the three children
born out of Hafiza- Samida (6), Tarpak Hassan (2) and Jainibi (4) on May 1
2001 and gave them poisoned food.

Later, he strangulated them to death and threw their bodies on the railway
track at Kalyan to show as if it was an accident.

The investigations into the death of the 3 children revealed that Naseer
guilty of crime and was arrested.
