This is the simplest and most obvious way to implement "overlays" and was proposed in the past. There are some problems with it, e.g. selecting normally deselects everything else, which might not be what you want, and shift-click is used to add to the selection. Shift-click is a hidden feature that most users don't know about. However, our current check mark in the sidebar is probably not anymore obvious to most users than shift-click.
Those of us with tablet PCs and UMPCs would prefer something that didn't involve shift- or ctrl-clicking, something that's not easy to do when you haven't got a shift key :-)
