Perhaps you are correct. But, these guys are lawyers. What we "think"
and what is legal are two different matters entirely.
The truth of the matter, as it applies to Han's application and as far
as it was explained to me through several written exchanges with the
legal team, is that anyone may use the logo and/or the name including
"Apache Open For Business", "OFBiz" and "Apache OFBiz" as long the
registered trademark symbols are clearly visible (at least one time
within close proximity of usage.)

My understanding, and as it was explained to me by the Apache legal team is
that you *may *use the logo and name if you give proper attribution. In other
words, clearly indicate that these are registered trademarks of the Apache
Foundation. Hans, you may want to check with the lawyers to get further
clarification.
I don't think they are anywhere near as concerned about attribution as they are
about misrepresentation of the Apache trademarks.
