Sorry for the misunderstanding. However, the same legal reasoning
applies. Depending upon the situation (i.e., how much the icons form
the corpus of your work) your work would be considered a derivative work
of the icon copyright. A very simple way to get around this (to be
perfectly legal) is to generate your own icons using one of the icon
generators (e.g., the KDE Icon Editor). Then YOU would own the
copyright to the new icons and you could do whatever you like with it.
Note, a bit-for-bit copy of the other icon probably wouldn't fly, but a
unique variation probably would. Copyrightability is based on
originality and that threshold is very low (unlike patents).
By the way, and more to your point, to get the image into dia, do the
following...
Start Dia and open a new document. One of the buttons in the top set is
"Create Image." Click it and put an instance on your new document.
Double-click the instance on your document to bring up a dialog box for
the properties of the image object. The top edit box and side button
will allow you to import a file. I know it works for .gif files. I
presume .jpg files will work as well.
