You should, not must, file a third-party disclosure; you could ask Danny McPherson to file one so you don't have to, but one way or another the IPR disclosure needs to happen so people don't step on a land mine. You are not obligated by the note well to do this--it's just the right thing to do, IMHO. Of course, now that we all know about it, anyone who's read this mail could in principle file the third-party disclosure.
