I've just joined the list but have been following this discussion 
through my wife. i'm thinking the following solution might be a good 
compromise:

1) import ALL comments (!!) into the system
2) flag all comments as hidden/suppressed except for these cases: public 
entry/public comment; anonymous comment; user-owned comment
3) allow the journal owner to contact the comment owners through some 
interface, whereby each comment owner will receive a personal email with 
some uniquely identifying hash
4) the comment owner comes to an interface (using that hash) that allows 
them to mass-approve/selectively delete comments for that journal

as for the case of a comment owner not taking any action... if there's a 
reasonable time period that's passed, maybe the comments would get 
switched on automatically, preserving the original privacy settings. but 
that just brings the issue back to legality. and if that's ok to do, i 
guess the above solution is overkill.
