thrown out of court. Additionally, the source code is GPL, so even if in the fictional world of Linus taking the trademark elsewhere, you can fork the code and call it Morphtkdlfgjfjdsksjfnmvmdkedkfjgjg, and you would be fine.
In that fictional world MySQL needed a fork and some GPL'd programs have been retroactively made completely closed source, forking denied after taking the issue into court...
