The "washer" is just a cushion (placed there so that you don't accidentally squash delicate components while putting the heat-sink on), and doesn't actually effect heat dissipation. It's always a nice touch, but not 100% necessary. The only thing that matters is the silicon on the bottom of the heat-sink. So long as that is in contact with the top of the cpu (the small shiny rectangular block in the center, surrounded by 8 resistors-2 on each side-), you are properly dissipating the heat.
I'm not sure why they wouldn't respond to you, but keep trying. Email them weekly, or more.
