I thing the suit is somewhat preemptive.  IBM acts concerned that PSI will
sue them for refusing to license the software.  Suing PSI for patent
infringement would make this sort of trust suit moot.  (Not a lawyer, however.) 

Also, all the PSI's advertising that you can run z/OS, etc. on their boxes
creates bad will with IBM customers.
