Reading over the recent mails on maps/orbs i have to throw my opinion in.
I do not think things like maps/orbs are the answer.
I agree i should not rely on 3rd parties to filter mail for my customers. As
a matter of fact..except for viruses, I think filtering is an action that
could be very expensive to your business.
.
It only masks the problem..does not fix it. I believe the problem will only
be fixed when public outcry demands a fix.
Using blacklists only delays or dampens that outcry.
I was not surprised to hear of orbs getting an injunction.
I believe that I,as a hoster could get sued by one of my customers for
restraint of trade or damages..if for example, i used orbs/maps and as a
result, my hosting customer never got a large order.
That is not our job and who are we to judge what mail should get through or
not to our customers.
It is not our business. We are interfering with their business operations by
doing so.
Does the phone company filter the phone calls you get? I believe that is a
good analogy.
Adiditonally, I tend to think blacklists do not really address the problem,
or fix the root cause.
I think the this spam solution can best be addressed by legisltation and it
will have to be federal legistlation as spam crosses state boundries.
I would expect most state spam laws to be struck down as violating
interstate commerce, though i am not an attorney.
Now, there are some bills in congress..but there is danger of the current
bill being quite weakened.
For comparision, there is a unsolicited fax law(so i've heard) that is
nation wide, where you can sue for 500.00 or more for unoslicited faxes.
We should have the same sort of law for spam.
Please check out http://www.suespammers.org to get an update on the fed law,
and also to see if your state has a spam law you can use. I also strongly
recommend you all write your senator, congressman and the president on this
matter. In the mean time, hitting the spammers in the pocket book through
civil or cirminal penalties, (if you state happens to have a spam law) seems
to me the most effective way to stop spam.
Ok, there is a lot of opinion in this email and i am not a lawyer.so please
do not crucify me!
This is just food for thought.

Kim
