Actually, most of the spammers are currently in the U.S., as far as I can tell (the main exception being the Korean spammers). They abuse overseas open relays, I believe that most are based in the U.S. But, this is what Habeas has to say about it:I personally like the HABEAS idea but I doubt in practice it will work well. They say the will be prosecuting on trademark and patent basis. while this is fine in the US it is really hard to do across international lines. So, prosecuting someone in the states would probably work but, most of the spammers come from outside the US and the laws are different.
5.4. What about spammers operating internationally?
International copyright law offers similar protection everywhere except Afghanistan, Bhutan, Ethiopia, Iran, Iraq, Nepal, Oman, San Marino, Tonga and Yemen. While such international prosecution is underway, the Habeas Infringers List can prevent spammers in these countries from misappropriating the Habeas Warrant Mark.
So it sounds like they are willing to go after overseas spammers, too.
