Actually, just like making a phone call into the state, once you cross the border, the law applies (you have at that point completed a transaction inside the state).
Enforcement is another issue (although TN did extradite some people from CA for breaking TN porn laws in the 80's and more countries will extradite internet offenders these days). I await a federal law requiring senders of email to wireless devices to pay for the sends (instead of the receiver) and the same for incoming cell phone calls (Verizon offered this long ago in the Denver area, not sure of the current status). It would be a fairly simple matter for the recipient to then get an allowance (no msgs or minutes) that he could monthly OK back to his bill (or allow all the time for frequent senders/callers).
