Terms and Conditions
Commercial ISPs
ISPs will have to meet a specified quality of service
which will be linked to the number of telephone lines to certain ratio of
Internet Bandwidth and down-load speed to be maintained at al times. Pakistan
Telecommunication Authority (PTA) will monitor the quality of service with the
help of Committee nominated by MoST consisting of Educationists. This
committee will monitor the performance of each ISPs on monthly basis and
submit report of PTA. If the performance of ISPs is found deteriorated in
consecutive three months, then ISPs will be required to pay at the prevailing
rates vide Tariff circular No. Rs, 17-2/2000/FC dated 20-04-2001 (@ US$
30,000/EI/Month). The facility of reduced rates will also be
withdrawn.
The following parameters are
required to be met by ISPs

d). To monitor the quality of service two free of
cost Internet Accounts will be |

Software Export
& I/T related projects, and Educational Institutions:
i.
The software houses will be
registered with PSEB and a standing committee consisting of MoST, PTCL. PASHA
and PSEB will ensure that the companies applying for this type of Internet
bandwidth are bona fide.
ii.
These software houses will be
billed for Internet bandwidth at the regime followed for commercial use of
ISPs (US$ 15,000 and scaled for lower bandwidth)
iii.
Every quarter, these software
houses will submit a Return (to be designed by this standing committee) which
will show a State Bank documented remittance of at least four times the
difference in the rates applicable to ISPs and Software Exporters (e.g US$
9,000lmonth for an El). The same shall also be applicable to sub rates
accordingly.
iv.
The Return will be validated by
the committee, which will meet every month. The difference between what has
been paid by the software Exporters (e.g US$ 15,000 and US$ 6000 for an El and
respective sub rates), will be reimbursed to the Software Exporters by the
PTCL. These reimbursements will be done within 15 days of the approvals of the
Standing Committee.
v.
This scheme has been designed to
help the generation of Software exports Educational Institutions and the
Internet bandwidth so provided will not be:
a.
Shared between software Exporters,
as this will be for the exclusive use of the buyer of this Internet
bandwidth..
b.
if the Software Exporter
/Educational Institutions also runs a commercial ISP and there is a chance for
this facility to be misused by diversion of this 'subsidised' Internet
bandwidth for commercial ISP or any other use (other than for which it has
been given).This facility will not only be withdrawn but PTCL shall have also
right to apply ISP rate i.e. @ US$ 15,000/El/Month, for the entire period. The
Software Exporter /Educational will run an additional risk of not being able
to gel any bandwidth from other sources of PTCL.
c.
If any part of this Internet
bandwidth is used for illegal activity, the Software Exporter /Educational
Institution will be additionally liable for legal action. Parties indulging in
unfair practices, violation of the leased bandwidth agreement or found
involved in any illegal activity would be liable to legal action as well as
immediate termination of the bandwidth (after short notice of not more than 3
days).
Note:
1.
The international Internet
bandwidth at the above mentioned rates would he available to the educational
institutions/universities approved by the UGC and the institutes affiliated
with the universities approved by UGC.
2.
Charges will be payable on monthly
basis in advance in Pak Rupees at the rate (US$ Pak Rupee Parity) applicable
on the date of payment of bill. The bills will he payable in 07 days from date
of issue. In ease of default, 5% surcharge will be levied. Nonpayment beyond
14 days shall warrant disconnection of the service. Default beyond 30 days
shall warrant disconnection of all services provided by PTCL or it's
subsidiaries.
Sales
Tax is not applicable for lSPs (except on local lead charges) Ref. SRO
No.1368(1)/98 dated 15-12-1998.

What does QOS cover? What
alternative proposal was submitted by ispak? Can i know this or can i have
copy? I presume all ISPs did agree to this, i just need this for my
info?

All our matters with PTCL are moving very much positive.
The delay to demand note to applicants was due to our proposal that there
should be a back-up with the applicant so we are making a policy on it.
Second, the condition of QoS was also under consideration with
Mr.Salman Ansari sahib . ISPAK had a useful meeting with Mr.Ansari and ISPAK
We proposed a alternative proposal for QoS to Mr.Salman Ansari and are
waiting his feed-back.
PTCL was going to issues demand note but I requested
not to issue till we solve the issue of back-up and QoS.
Back-up issue is very much important. If a
user have this single source and there is breach of cable , the
restoration will takes minimum 15 days, then he will start to
cry. I desire to avoid this situation
Connectivity on
STM-1 should only be given to those who have already back-up or
PTCL arranges itself as it being done through TIER-1 , .the second
issue of QoS is most important and it should also be decided mutually MOST
and ISPAK. other wise there will arise many disputes

Dear Mr. Faisal Naseer,
Thank you for your e-mail dated 05 July 2001. As you are
aware it is only about two weeks that the submarine cable became
operative. You said that your application has been pending for two
months but this is irrelevant, since the facilities were not previously
available.
I am now writing to PTCL to provide you the necessary internet
connectivity expeditiously. I hope that will soon be done.

phone about this. We received the demand note today but were informed by
competent PTCL employees that the link has been down for a week now
and it is non-restorable , i.e if the link goes down we will not
have the option of a backup link. If this is the case then i dont think
it will be feasible for any ISP to switch over on the STM-1 without
backup. I hope this missing backup link problem can be organised soon as
it will be beneficial to both PTCL and

upgrade to 2MBPS on the SEAMEW-3 Fibre Optic Cable on the New Rates
Announced by your goodself and PTCL in the Dawn Newspaper we are
once again put into a very difficult position. Our application for
the above circuit has been pending for the last 2 months now,
despite contacting all concerned departments in Karachi we still
have not received our demand note. Although the demand note is with
DE VAS it has not been signed. Despite our repeated requests to
expedite the matter we have been put on the verge of shutting
down our operations. We have already submitted our termination
letter to our half international circuit provider Teleglobe which
will expire on the 31st of July 2001. If PTCL does not issue us the demand
note and provide us with the 2MBPS link before the end of this month
in effect our services will be shut down. It is my request
and hope that you will help us in this situation and issue necessary
intructions to the concerned PTCL deparments to expidite our 2MBPS
