Not sure how this would affect a fork run out of Russia or Australia, though the US courts would probably roll over. Also need to point out that the song that was plagiarized did not have an open source license attached to it nor did Madonna's song credit the person who made the claim.
Interesting example, but the US has its share of over-the-top judgments re copyrights. It was one of the driving forces behind the GPL. I'm on the fence about a fork, but I'm pretty sure the LGPL allows it. Edward W.
