They can.  Only, they won't get a response.  If they repeat it, someone
will yell at them / post links on how good or bad top posting is. 
Others will simply delete their mail and go read other mails.

There are ways ... majordomo had filters which would bounce your mail if
the percentage of quoted text to actual text was too high, for example.

Some filters like that could be implemented, if possible.

The other way is "just hit delete" on people that you know will just
post nothing but html / top posted, fully quoted digests with single
line replies / whatever.  Automatically if you like - procmail is your
friend.

Even better, get a newsfeed from gmane.org and read the li-* lists on
that using gnus or slrn  ... I think they are available on gmane now.

Making the LI list administration into a police state because of this
will do far more real harm than all the html posting outlook users can
manage to do.
