It is not a system based on justice, but a system based on "precedence". The interpretation of a legislated law by a court sets " precedence" and once accepted after all appeals are used up, the courts decision defines the law. (Until of course, new legislation is passed). So do not expect an outcome based on what is fair or just, the outcome will be based on "law" (see U. S. Govmnt vs. Microsoft, was that fair or just??) just my $0.02 pessimistic as it is.
