I'm sure sourceforge's lawyers know what they are doing, as they have interest to. Individuals are personally liable for the export of controlled items, including large fines and prison terms...
On the other hand the checkbox is the project admin saying the project complies with US export control regulations and so its the projet admin that would go to jail rather than the sourceforge lawyers.. Without the checkbox sourceforge themselves would be exposed to this risk..
