According to the (newly posted) Overview section of the SRD:
<<The terms "3rd Edition", and "Player's Handbook" are not Product Identity.
We suggest however that you refrain from using these terms, as they may be
confusing to future users of this material and they may be rendered obsolete
by future marketing strategies or product releases.>>
Now, this doesn't outright state that "3rd Edition" isn't a trademark, but
the implication is strong that using the term would not be a violation of
the d20STL.
