It says that "3rd Edition" are not Product Identity. Trademarks 
would be PI, so hence reason suggests that it is not trademarked.

Using the two terms listed are NOT prohibited. There is a 
suggestion to not use them, and there is also very good reasoning 
behind those suggestions as well.
