I went back after looking at the legal.rtf that's currently posted. They have apperantly updated it, as the d20 part that stirred up this lovely storm has been changed. Quoting in it's entirity.

Since I don't have the 3.5 books on hand yet, and Hasbro/Wizards hasn't registered a trademark on d20, and the D20 Modern book I have on hand doesn't claim d20 as a trademark in the colophon ( the registered trademark is for "d20 system" and the D20 system logo, FWIW ) I'm curious what the (gladly more clarified) context means.
My reasonable man's presumption is "d20 (when used a trademark)" means any usage where "d20" is effectively shorthand or an abbreviation for "d20 System." -- which is a registered trademark. This certainly doesn't seem out of line.
At least it ends the "you can't declare a die as PI!" nonsense. :)
