I'm going back to the original message for clarity,
After talking to my Mr. Lawyer Person friend who is quite interested and follows
Computer law. I have this comment.

The U.S. Government has no clue what Software is and have only slightly more of
a clue what a computer is in the first place. That's why copyright law for the
software industry is so screwed up. From what he told me (and I'm not sure how
this impacts the GPL) It would be best If the OGL specifically stated what is
covered by the clause.

 If the publication you are
distributing includes software that contains Open Game Content, the complete
source code of all files, executables, runtime libraries etc. that contain the
content must be licensed using the GNU General Public
License (GPL).  Information about the GPL may be found at www.gnu.org.

By explicitly stating it, the lawyers will have an easier time of it, and the
developers will know exactly where they stand.
