I believe the base assumption is that ANY new "rule" written in an OGL
document is OGL'd.  So if I were to create "Street Samuri" for my games, and
included a detailed history and training ceremonies--the RULES for them would
be OGL'd, but I *could* keep closed the history and training ceremonies.


For software--whatever they add or change to the d20 game should be open,
somehow.  I really can't comment on what their digital game-engine and the
rest should be...
