That's exactly what I mean. You have to ask the hostage taker
for permission, regardless of how the trademark laws and practice
currently stand or evolve in the future.

True. I think I just see the freedom to publish a module that
is "compatible with Snakemen of Blablabla" more valuable than
the right to prevent you from publishing a module that is
"compatible with Swamp Adventures." I'd rather have freedom
to do something than the right to prevent others from doing
something else, when both actions are comparable.
