The remedy depends on perspective.  I wouldn't be surprised if the IRS expanded the tax liability in future open communities. I would be surprised if they gave tax-paying companies a break.  But I think what will happen is that, like Microsoft, gaming companies will simply adapt and learn to compete in a new way.  Only time will tell, of course.
