Okay, here's another example of OGC declaration that confused me, given what we have been talking about. I'm gonna use specific product names.
I was checking out at the store Malhavoc's The Bonds of Magic by Sean K. Reynolds. I go to the s.15 and I see the standard Malhavoc copyright notice that lists all their products to date (c) 20XX Monte Cook. As I am checking the spells section I see that one spell has an asterisk and there is a copyright notice at the bottom of the page. It said (not verbatim, my memory is not that good) "The spell holy channel appeared in Relics and Rituals and is (c) 20XX Clark (I forgot your last name). It is used by permission." But this copyright notice was not part of the book's s.15 when as far as I understand it should be.
If it is used by permission, rather than through the OGL then it doesn't need to be in the Section 15. (Someone will correct me if I'm wrong.) Without having the book in front of me, I would suspect that it should probably be in the S.15 and contain the "Used by permission" designation. Both. The OGL would cover the SRD derived OGC and the Permission is for the product identity/copyrights.
Whoa, 3 posts in a row. I gotta go lie down.
Cheers
