No, because the 'unofficial' SRD was never placed under the OGL. For nearly three years, D20 publishers and WOTC have worked under an informal gentlemans agreement, which is, roughly, "You may use the unreleased portions of the SRD *as if* they were OGC, provided that you make all required changes when they are formally released."
Every publisher knew -- or SHOULD have known -- that those were the rules, that, basically, there was a gamble.
