For that matter:
Try to name any specific community contributed code that ever went into
solaris/opensolaris code.  

The parts which are owned by oracle (kernel, zfs, dtrace, etc) were
developed entirely, or almost entirely by oracle/sun employees.

Even if you want to make your case "oracle didn't pay for development of
some of the code which is in oracle copyrighted files, and that matters in
germany," you have to be able to identify some code in some files, which is
copyright oracle, but contributed/written by somebody who wasn't paid by
oracle.

And oracle's easy response, even if you can find something like that, is to
simply chop it out.  If they remove the parts that you contributed for free,
once again, you have no case to try and force them to open their code.
