Thanks for your input Mike.  But I just want to add something to the 
discussion before it gets any deeper into legal speak.

Really I just wanted to make it absolutely clear that the goals here 
/are/ interoperability and that there is no desire to reverse engineer 
Macromedia products - and certainly no intent to compete with Macromedia 
in either a commercial, or non-commercial way.  If the next version of 
the Flash IDE will feature a command line compiler that can be legally 
used separately from the IDE (e.g. so it can be used under Linux), then 
there is no longer a requirement for an open source compiler.
