So you admit there was NEVER a Palestinian State, as such... As to legal authority in 1948 was the UN, regardless of how many members it had, it decided to make two new nations, Israel and Palestine, in UN Resolution 181... If invalid for Jews then invalid for Palestinians... That is to say if your position is there shold have been no Israel, then it follows there should be no Palestine... It was after all the project of Moslem Mecca refugees to establish a Palestinian state after WWI, another group of imposed immigrants on Palestine...
Your argument is that because Jews were only recent immigrants, the UN Resolution with regards to Israel (not Palestine) should and must be ignored... The question is how far back does an immigrant need to be to be considered??? Is it as in Tibet regarding Chinese immigration since 1950??? If so, they are all not to be considered... Is it as in South Africa where white Afrikaners and black Bantu immigrants "invaded the Bushman's land 600 years ago and both group should be tossed out... I have yet to seen any clear logic why in Israel's case Jewish immigration since 1900 should be not considered valid while Chinese immigration since 1950 be considered valid... Second what do you do with rights of the equal number of Jewish immigrants from Arab lands (most kicked out, threatened, and with the expectation of loss of property or life) who moved to Israel??? Does Syria, Egypt, Jordian, Iraq, Iran, Saudi Arabia pay them reparations and give them back their land??? In the end, the state of Israel was create for varying geo-political reasons in 1948, just as it opponents argued for a creation of a single Palestine state for varying geo-political reasons... The rationale you are citing now is met to justify a position after the fact... On Iraq I know... your position in effect is "until proven otherwise Iraq can not be a democracy, therefore it should have remained under the rule Saddam"...
