As I have said before, unless they cross one at a time without having planned the crossing or spoken of it to ANYONE it is indeed civil as you say. When the Illegal entrant has planned or crossed or planned with at least one other person it is a felony.
That would mean of the 500,000 or so that cross annually there may be one or two that fit your category which leaves us with 499,998 to 499,999 felons entering the country. It matters not that law enforcement enforces the law....... It IS the law.
