Should you not open as sRGB and convert to Adobe 98? Does your method not
ignore the embedded profile and just say this file is Adobe98 when it is
not?

If you know it has a profile (recognised or not) then you should open it
with that profile and either work in that colour space, or convert it to
your preferred one.

The opening over a network difference is more subtle :-)) what systems are
you using?
