The whole thing boils down to the definition of an ESS. Getting the inspector to realize that the 706.2 disconnect is not required to be a battery disconnect is key here.

You hint at a broader point:  The industry is not providing solutions that the regulators are demanding.  Any battery with BMS should have a remote inhibit.  Problem solved.

The problem I see with just complying is that there is really no practical or cost-effective way to comply. You would have to somehow transition from battery cable to some other cable type, because typical fusible disconnect switch lugs are not going to be rated to accept fine-stranded battery cable, especially in the required size.
