I don't know legally, but I would not vote for an incubator release of stuff from the com.sun address space. So practically, you should make the change before you consider making a release. When I say release, I'm talking about the formal release process, not putting stuff into the Apache svn incubator repository. You can put anything in there that has had the incubator IP review done.

namespaces with most of the specifications in net.jini, but some of the essential parts also in com.sun.jini. I think (didn't pay too much attention at the time, so I might be wrong) the rough consensus was to keep net.jini as the spec namespace and to migrate from com.sun.jini to org.apache.river by time as the potential backwards compatibility
