 probably have no contol of it since it's Toshiba that's isueing the rebates.

 This deal has already been running for a number of days.  No doubt one or
 more people have already ordered large lots that dried up their suppies.

 However I think it was Gateway I ordered some 110 memory from when they were
 out of stock, and they were restocked and shipping in a couple of days.

Depending on how much extra would be involved for shipping/handling, $24USD 
sounds reasonable to me ...

I talked to him and he's interested in doing it but wants to be sure
about the rebate. I'll call Toshiba and see if there are limits on the
number of cards and whether they'll fax me a guarentee they they will
refund the money. International buyers- send me a private email on
whether you are interested in buying cards at 24 dollars a card plus
international shipping (US postal, Fedex, UPS, EMS?) and how many you
would want. Money for the cards would have to be predeposited in my
paypal account before 14th and then I would buy the 14th and ship as
soon as I got'em. The offer ends the 15th so we have to move fast.

This is still contigent on whether the guy will do it (since I am
broke- heh) so nothing is written in stone. So if anyone else wants to
do it- feel free.

Nope, What counts is you meet the dead line, that requires that you have the
device in your hands by 9 13 2002, so that you can included the original
serial number label. Also in the US most companies use the date of shipment
as your date of purchase. That is when your payment is processed.

Looking at Gateways Payments terms, I for one do not care for this:
Gateway may change prices without notice to you before Gateway enters your
order and

may modify and substitute products and components without notice to you
prior to shipping.

Way to many loopholes for my taste.

Depending on how much extra would be involved for shipping/handling, $24USD
sounds reasonable to me ...

Is 24 dollars US a card too much?  I might be able to put together
about 5 grand for buying a bunch of cards. It wouldn't be my money so
they'd need a decent profit. There's no guarentee Toshiba will pay the
rebate, though. It has to be done before the 15th. Money could be
deposited through paypal.

Now I'm going to have to figure out if I cancel the order.  If they send a 
receipt dated the day it ships, it will most likely be outside of the 
rebate period.

Okay... I just spoke to people at Gateway twice on the phone.  I'm still not 
clear on everything, and am waiting until Aurora comes back from break to 
iron out wrinkles.

But here's what I've found out, prioritized from top to bottom in my mind:

1. The Gateway order can be cancelled before they send you notification via 
email confirming shipment.  BUT (this is why I have to talk to Aurora), 
THERE’S NO GAURANTEE THAT YOUR CANCELLATION WILL BE PROCCESSED.  It has 
something to do with whether or not Gateway had sent a notice to their 
supplier to request a mass order for the back ordered unit, or if your they 
just sent you’re order to their supplier for the back ordered unit.

2. The order must be made on or before Aug. 15th.

3. Within an hour or so of placing an order, Gateway sends a receipt that 
can be printed out and submitted with the rebate coupon

4. The rebate coupon, receipt, and serial/part# info from package must be 
postmarked on or before Sept. 15th 2002.  If you haven’t received 
notification of shipment by Sept. 2nd or 3rd, you may want to cancel the 
order.  Again, more info on cancellation coming.

5. Toshiba must receive the rebate documentation at their rebate center in 
New Rochelle, NY by (on or before?) Sept. 30th.

6. I was told a second sales receipt would be sent either as part of the 
email notification of shipment, or as a separate email at that time.  
Another Gateway person said the receipt is only sent once when the order is 
received.

7. As of about 4:00PM EDT, Gateway had 80 orders for this 2GB Toshiba backup 
drive.  10 of those were orders for more than $1000.

Man... my head is spinning.  As you guys have probably deduced by now, I’m 
not that good at processing masses of information quickly, and end up 
beating my head against the wall for a few days until things sink in.

I suggest someone else call Gateway at 877-285-6043 and see if they can 
absorb and digest the whole deal about what happens if an order is put in on 
this drive, and then it’s put on backorder.  And... just what the deal is 
with cancellation of the order.  The cancellations aren’t guaranteed, as 
Gateway waits a while to confirm that their supplier can’t in fact supply 
enough of the units to fill all the orders.

I got Crystal (of only 4 people there, including Carla and Aurora) at 
Gateway who has been going over and over all this with customers all day.  
She said that within 3-5 days, a notice will be sent back to a customer 
about their order telling them whether or not the item had to be put on 
backorder.  But it seems Tom got such a notice within an hour or so.

She said that when their warehouse runs out of an item, Gateway has to send 
a backorder request to their supplier.  Then they have to wait for the 
reply, in which the supplier confirms whether or not the item can be shipped 
to Gateway within 30 days.  Gateway then sends the customer email notifying 
them that they’ve received that information from their supplier, and that 
the item is expected to be shipped within 30 days.

But she said that Gateway has been out of stock on these drives since the 
1st of August, and that they sent a request to their supplier to supply the 
number of drives they had received orders for at that point.  It’s the 10th 
now, and they haven’t heard back from the supplier yet.

Also, this offer was first made by Gateway on July 15th!  Probably why they 
ran out of stock by Aug. 1st.

I ended up going in circles with Crystal about just what the scenario might 
be if I ordered today.  Would the request Gateway put in on the 1st cover my 
order, or would Gateway have to put in another request to their supplier for 
recent orders.

Since the supplier hasn’t written back, Gateway has no way of knowing at 
this point how many of the existing orders they can fill.  I’m assuming that 
they probably will wait for that information to see if they need to place a 
2nd order.  So I guess it’s very possible that orders made now, may have to 
wait for a reply for a 2nd request by Gateway to the supplier.  Again, a 
reply to such a request by Gateway is SUPPOSED to come back from the 
supplier in 3-5 days.  The supplier's reply will say either they're out of 
stock, or saying they’ll ship to Gateway within 30 days.

So say this coming Monday Gateway receives a reply to the order they placed 
to the supplier on the 1st indicating that X units will be shipped within 30 
days.  If X units is not enough to fill orders placed between the 1st and 
Monday the 12th, Gateway will have to send a request for more units.  But 
say the supplier doesn’t reply for another 10-12 days.  That’d be the 22nd 
or 24th of this month at the longest.  30 days from Aug 24th is well after 
the deadline on the 15th of Sept. for the rebate to be postmarked.

Then where does the cancellation process come in, and just how does it work 
if it isn’t instant, and they have to spend a few days to process it?  
Gateway probably waits until they hear from the supplier in order to cancel

The phones at the Gateway Shop are supposed to be open until 6PM PST 
according to their website, but I’m wondering if that should be PDT.  If I 
have the energy, maybe I’ll give them another call.  But it’d be great if 
someone else who can absorb and process a lot of convoluted parameters 
quickly and efficiently [obviously not me :-0] could give this a try.

Matt I read through there info on the web site, I talked to the people at my
local store. I came away with a bad taste in my mouth. The fine print reads
you can order a Toshiba 2GB hard drive for 119.99, but they can change your
order to Kingston, or anything else they feel like, and ship it to you
without telling you, they can change the price to anything your card will
take, again without telling you. Now I'm not saying this is what they are
doing, only this is what they feel they can do. Add that to the fact that it
is listed as in stock when you order, and the you get an email saying it is
backorder. I don't do business with people who think they have a right to
treat me in this manor.

Check the page they are still showing it as in stock and it will ship in 3
to 4 days. So that is a lie. When the price is to good to be true, it
generally is. You want to give your money to a company that lies to you
right off, go for it my friend.

Okay folks, I ordered one.  It’s probably because I was totally charmed by 
Aurora at the Gateway Accessory Store.  She had the softest, sweetest and 
most informed, intelligent and patient sounding voice I’ve heard in a long, 
long time.

But she did report unofficially she had heard that Gateway received around 
2500 drives today, and that orders placed as late as this morning where 
showing up in the computer as having been processed, and notices sent out 
that the shipments should be received in 4-5 days.

Orders may not be able to be cancelled in a circumstance where it turns out 
that the item was shipped before the cancellation was processed.  So 
canceling by the 2nd or 3rd of Sept should sufficient time to avoid getting 
the shipment later than the 15th.

If the shipment IS received after the 15th, she said that the delivery could 
be refused, and sent back to Gateway for a refund. If you receive a notice 
from Gateway saying the item has been shipped, or you if find out by 
contacting Gateway that the item has been shipped...   AFTER the point where 
it will received after Sept 15th…  you can call Gateway and get a return 
authorization.  Again, she said that the full amount of the purchase would 
be refunded.

With all of the deadlines and conditions that this deal is wrapped up in, 
Aurora (great name too) was guessing that the odds are really pretty good 
that an order placed today will in fact be processed, the item sent and 
delivered in time to meet the Sept 15th deadline.

So it’s a $112.95 gamble that I’ve been enchanted into believing is a good 
one.

Don’t forget to get the $10.22 free UPS ground shipping rebate ‘coupon’ 
number from the link on the item page.  I guess $112.95 before rebate 
qualifies as an order over $99.  Gateway and Toshiba can duke out the rest.

Hey David,

I'm the first to be suspicious of a lot of what I find in all the fine print 
in deals like this these days.  This one was really convoluted with the end 
of the offer looming, being out of stock, and the Sept. 15th deadline to 
post the rebate.

Other than the time a novice Gateway tech told my brother to install a 2nd 
copy of Windows (3.11) in a C:\Windows2 directory that had a team of people 
locally scrambling to try to clean up the pieces, the vast percentage of my 
experiences with Gateway in the past 7-8 years now have been extremely 
positive.  I’ve had to help friends get RMAs to return and replace hardware 
bought separately or with a system that broke down (including 2 HP 
scanners).  I’ve worked with Gateway’s tech support more times than I can 
begin to remember for many relatives and friends.  I’ve ordered accessories 
from them that have all been top notch pieces of hardware that were very 
reasonably priced.

So considering my history with the company, and the information given to me 
in Aurora’s mesmerizingly and enchantingly sweet voice, I decided to drop 
$112.95 down on a calculated gamble.  But I certainly wouldn’t want to 
gamble on ordering a massive lot at this point.

The odds to are extremely good that if I got cold feet, and canceled the 
order by next week, my credit card order would be nullified.

I just checked my mail, and received the acknowledgement of the order from 
Gateway that will serve as my receipt for the rebate.  About 3 hours have 
gone by now since I submitted the order, and at this point I haven’t gotten 
any email from Gateway like list one Tom got last night:

 Okay... I just spoke to people at Gateway twice on the phone.  I'm still not
 clear on everything, and am waiting until Aurora comes back from break to
 iron out wrinkles.

 But here's what I've found out, prioritized from top to bottom in my mind:

 1. The Gateway order can be cancelled before they send you notification via
 email confirming shipment.  BUT (this is why I have to talk to Aurora),
 THERE’S NO GAURANTEE THAT YOUR CANCELLATION WILL BE PROCCESSED.  It has
 something to do with whether or not Gateway had sent a notice to their
 supplier to request a mass order for the back ordered unit, or if your they
 just sent you’re order to their supplier for the back ordered unit.

 2. The order must be made on or before Aug. 15th.

 3. Within an hour or so of placing an order, Gateway sends a receipt that
 can be printed out and submitted with the rebate coupon

I ordered yesterday...
I see an order Notification email, but it doesn't have any info in it even
closely resembling a receipt for a rebate.  That was then followed by the
Backorder email.  Nothing since.





 4. The rebate coupon, receipt, and serial/part# info from package must be
 postmarked on or before Sept. 15th 2002.  If you haven’t received
 notification of shipment by Sept. 2nd or 3rd, you may want to cancel the
 order.  Again, more info on cancellation coming.

 5. Toshiba must receive the rebate documentation at their rebate center in
 New Rochelle, NY by (on or before?) Sept. 30th.

 6. I was told a second sales receipt would be sent either as part of the
 email notification of shipment, or as a separate email at that time.
 Another Gateway person said the receipt is only sent once when the order is
 received.

 7. As of about 4:00PM EDT, Gateway had 80 orders for this 2GB Toshiba backup
 drive.  10 of those were orders for more than $1000.

4 people at Gateway during 4 calls, (obsessiveness and slow to comprehend as 
I am) confirmed that the first email you get, when printed out, will in fact 
qualify for the rebate.  But from the day you got that email, you have 30 
days until you have to put the rebate in the mail and have it postmarked 
less than 30 days from purchase.  Apparently not from the time you receive 
the drive.

Also, you ordered yesterday, got and got that backorder notice an hour 
later.  Aurora said that a shipment came in today, and orders that were 
pending were showing up on their computers as having been processes.  I 
ordered today, got the order notification, but did NOT get one of those 
backorder notifications.  At least not YET.  And I may not.  She said that 
if the order can be processed and sent in 3-5 days, that notice doesn’t get 
sent out.

But if it turns out that within 3-5 days after my order, they run out of 
stock again before they get to processing my order, I WILL be sent one of 
those notices.  That will mean that they have to put in yet another 
re-supply order.  In that case, it may take another 10 days to receive 
notice back from their supplier on whether they have enough stock to ship.

So I’ll just keep a close eye on my email and the calendar.  If things start 
to feel edgy, I can always cancel the order.

Is 24 dollars US a card too much?  I might be able to put together
about 5 grand for buying a bunch of cards. It wouldn't be my money so
they'd need a decent profit. There's no guarentee Toshiba will pay the
rebate, though. It has to be done before the 15th. Money could be
deposited through paypal.

Why would there be a problem in getting the rebate? The 15th is 4 working 
days away ... or does it need to be posted in? (I can't get to the site at

Depending on how much extra would be involved for shipping/handling, $24USD 
sounds reasonable to me ...

Is 24 dollars US a card too much?  I might be able to put together
about 5 grand for buying a bunch of cards. It wouldn't be my money so
they'd need a decent profit. There's no guarentee Toshiba will pay the
rebate, though. It has to be done before the 15th. Money could be

You folks have dealt with rebate offers like this in the past, right?  Sure, 
you can buy as many as you want online, or maybe by phone (has anyone 
called?).  But are you going to fill in a rebate slip for each unit, and 
fill in the same name and address for them to send the rebate to?

Then there's the deal of their wanting the original retail cashier's sales 
slip.  Has is been confirmed that an email, or whatever notification Gateway 
sends (assuming they will), will qualify for the rebate?  I would hope so.

Even so, if more than one unit is purchased, isn’t it possible that the 
computer at the rebate center will pick this up while processing multiple 
rebate applications with the same ‘cashier’s receipt’, and the same address 
to send the rebates to?  I once had a CompUSA rebate denied after 3 months 
because I didn’t notice I posted the rebate one day after the deadline, 
about three days after I purchased the product.

Here’s a quaint section of the rebate terms:

.  “Fraudulent submission of multiple requests could result in federal
.  prosecution under US Mail Fraud Statues (18 USC 1341 and 1342).”

This is a wonderful time to be testing the ability of systems to catch 
fraud.  That said, it is temping to at least try putting a couple purchases 
through the system, huh?

Matt,

It does not say one per person or household, just one per product.  The only way
you'd be sending fraudulent multiple submissions under this wording is if you
copied the UPC and tried to redeem 2 rebates from one product.

Also, note that the rebate is only good through Gateway, so they'd BETTER take
the packing slip/receipt as valid.

If I were going to buy more than one, you can BET that I'd take the time to send
in one per envelope - a $100 rebate is worth a stamp!
