There was some acknowledgement / agreement that as long as the default settings were within the FCC regulations there was no problem with the source being publicly available. I think having to modify the driver/firmware and then compile it is non-trivial for an end-user. Even for a developer with the knowledge I'd think it is fair to say it is not quite trivial. The way it is distributed a developer has to go through the source code, make some changes, and compile, before the device can be used outside of the FCC regulations. Don't quote me on that... although I believe this is how things are. I have not done it myself. Only read about it (year(s)? ago when this was all going down).

With regards to the BIOS patching, I should firstly add that it is a potentially risky process and it might leave your laptop in a non-working state. This might just be a routine warning, as I don't know how often the process fails. Having said that, I did in fact patch my BIOS (IIRC: http://forum.notebookreview.com/lenovo/459591-t61-x61-sata-ii-1-5-gb-s-cap-willing-pay-solution-8.html#post6501443) but it was for the SATA speed and not for the whitelist, although it is the same patch. I have not tested whether an alternative wireless card works, so I cannot comment on that. As mentioned, having a USB wireless adapter is useful in any case. I had to run the patch, which is specific for the 60/61-series, in Windows. Luckily (!) I had Windows Vista on the laptop when I got it. The patch was the only thing I did with it before I installed Trisquel.

I've bought the USB wireless adapter from Think Penguin. I'm in New York so it should be here soon. I will see about updating an entry to h-node.org. I have a handy URL address I could link here,too, about my system...instead of typing it all out. I'll just need to find it. Thank you for linking the information about the BIOS. And the summary information on the DRM, lembas. I'm interested in altering this at any expense to obtain a further conversion, away from copyrights. And as long as it's environmentally conscious. Actually, It's FCC regulations that forced IBM to Whitelist their Wireless Cards. I have a possible solution, but it involves using non-free utility once and then you can remove it once the job is done. (well, I only know of non-free utils for this, there might be free ones that I'm not aware of) Anyway, it involves hacking your Bios, my friend bought a Thinkpad T420s for his networking class and his networking card and it didn't work with certain protocols with GNU/Linux. so he bought the best wireless card he could find and it didn't work because of the whitelist, so he hacked his bios and now he uses whatever he wants. However flashing a modified bios could brick your laptop and the method I know of involves using non-free software, but if I was sure it would work, I would recommend it because your bios isn't free anyway and I would like to know if anybody here actually uses coreboot. Out of convenience and and paranoia that the process could eff up your laptop because something went wrong, I recommend the USB adapter.

While this was initially the explanation given they have since flip flopped. The flip flop occurred because the FCC explicitly said there was no such requirement. Everything suggests a financial motive. I also want to point out that while IBM/Lenovo may have been the first company to implement this they are not the only company implementing a white list. I can confirm these restrictions are in place on at least some HP, Lenovo, IBM, Dell, and Toshiba notebooks. At this time I don't believe there to be any other manufacturers implementing such restrictions on the installable PCI/PCIe cards.

Have you reported that card to www.h-node.org ? It would help. I think I found your laptop from h-node (http://h-node.org/notebooks/view/en/391/ThinkPad-T42-type-2374). It seems to have a different card which is reported as working. Maybe you could try to find one of those. You can also contact ThinkPenguin.
