You're right, I guess. They had an incident which involved personnel policies--did an employee do the right (or the wrong) thing. No organization I've ever run into is going to handle such a thing in public--would you expect there to be broad neighborhood publicity if this were you, and your employer? Presumably, at some point, John Fenton's employment status will change--he'll go back to work, or otherwise. Sorry-I guess I missed the detail about the IRS amongst the rhetoric. I have plenty of patience. I don't view John Fenton as guilty of anything. John Desmond has offered a scenario, but I think really getting into the details is purposeless, since none of us is familiar enough to have them be useful, anyway. My own take on this is: Jannie Blackwell's office called and asked for help setting up a fair in the park. John Fenton went, and took his community service folks with him. Since this is election time, the fair had some unexpected angles to it, and all concerned will do it differently next time around. I really don't see anything that smells here. *ROSTOCK, Germany* (AP) -- Masked demonstrators showered police with grapefruit-sized rocks and beer bottles, then were driven back with water cannon and tear gas during a protest march Saturday against the upcoming Group of Eight summit in Germany. The clashes left smoke from burning cars and the sting of tear gas drifting through the harborfront area in the north German port of Rostock. Some 146 police were hurt, 25 of them seriously. Radicals are smashing everything in their way to pieces, said Karsten Wolff, a police spokesman. The officially permitted march preceded a three-day summit beginning Wednesday in the seaside resort of Heiligendamm, where German Chancellor Angela Merkel hosts the leaders of the other G8 nations -- Britain, France, Japan, Italy, Russia, Canada and the United States. The leaders are expected to discuss measures against global warming, the fight against AIDS and poverty in Africa, and the world economy. As in previous years, the summit drew protesters of various stripes opposed to globalization, capitalism and the G8 itself. Most marchers were peaceful, but others pried up paving stones and broke them into chunks before charging police. Officers in helmets and full body armor fell back, then charged the demonstrators. Five large green police trucks with twin water cannons mounted on top blasted groups of rioters. A police car was destroyed and several parked cars burned, spreading black smoke over the area. [UC] IRS Treatment of third-party information relating to tax-exempt organizations
UCD continues to be less than forthcoming about the internal investigation of its violation of the laws under which it operates as a tax-exempt organization. Namely through the use of its resources on behalf of a political candidate in the recent mayoral primary. Those of us who question the NID proposal by UCD, which includes UCD's management of what amounts to a QUANGO in the event it does happen to be formed, have been holding back on filing complaints with the IRS questioning UCD's tax-exempt status. While UCD supporters keep saying this is a private matter internal to the organization, they are forgetting two key issues: 1) As a tax-exempt organization, the organization's policies and modus operandi are legally and morally a matter of public record and public concern. 2) As the organization that proposes to impose a real estate surtax on some (it'll most likely be all if the bill is to have any hope of not only passing but surviving a chanllenge under the uniform taxation clause of the State Constitution and under the principle of rational nexus as detailed in the state legislation enabling NIDS), UCD's chains of responsibiliy and accountability are very much a public concern (i.e., making Fenton a scapegoat and letting Lewis and the Board of Directors off scot-free ain't gonna cut it). But as you pointed out, there's still not enough information and I'm not a lawyer, but I'd guess that if someone went to court with the evidence that exists now (the newspaper article, the TV news story and the malcom x park video) it would be dismissed very quickly. There are endless iterations of the allegations which would all be born out by what we know now: 1) UCD illegally and unethically aided in setting up a political rally. 2) UCD helped to set up a church picnic. The church illegally or unethically invited a political candidate to speak. 3) UCD helped set up a church picnic, Jannie and Tom, realizing that there would be a lot of people at the church picnic came of their own volition. 4) There were several different groups independently using the park on one afternoon. 5) Prisoners were forced to hand out Tom Knox signs and fliers. 6) Prisoners observed Tom Knox signs and fliers already there or being handed out by other people. as someone else pointed out, speculation gets us nowhere. I'd guess that the investigation won't be over until John Fenton's two week leave has expired. If someone wants to file a lawsuit before then, I'd say knock yourself out, but it seems like a lot of wasted effort. But we do have a number of bona fide lawyers on the list who might be looking for some extra cash if anybody wants to hire them to get that ball rolling. kc
[UC] Kudos to Best Fest clean-up
It's past 10:00 p.m. on Saturday night, there was a festival and large crowd in Clark Park in and around the bowl today, and there is a very quiet crew of people working their way around picking up every piece of trash, although from what we could see when we just came home, the park is already almost spotless. Trash bags are changed in every trash can, and the full bags neatly piled. I guess they're just going over the grounds again, making sure it's truely cleaned. Wow!
