Hi May I clarify, the views expressed here are that of mine and not of the list. One need to differentiate the difference between handicap and disability. One loosely interchange it however, disability refers to the physical condition whereas handicap has a psychological connotation. Handicap also refers to something which restrains or hampers, hinders. Here the word is symbolic in nature and one has to interpret it with the correct context. He also submitted that Ms. Nitu, a person with blindness who had applied for the posts of Stenographer and LDC published in Employment News dated 16-22 July, 2011 had been directed to appear for the skill test using inscript keyboard. The test was to be taken on computers and the inscript keyboard is different from manual type keyboard and does not have any facility of screen reader which is a great disadvantage to persons with visual impairment. Besides, such an arrangement also adversely affects the performance and prospects of the candidates with blindness and low vision. He also stated that standard screen readers like JAWS for English and SAFA for Hindi were not being allowed in the skill test fixed for 10.01.2012. As the SSC did not file their version, a hearing was scheduled on 05.1.2012. 5. The petitioner felt dismayed by reading this W.P.(C) No.23123 of 2005 Page 2 of 18 1.. advertisement as it did not provide any reservation for Physically Handicapped persons („PH persons‟ for brevity) though the Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1955 (hereinafter referred to as „the Disabilities Act‟) mandates that 3% reservation is to be given to those persons suffering from disability as defined in Section 2(d) of the Disabilities Act. This prompted the petitioner to file the instant petition, in the nature of Public Interest Litigation questioning the non-provision of reservation to the PH persons. 2.. 2. The instant petition is filed by Shri M.K. Rastogi, Chairperson, Advocacy Employment Committee of the petitioner organization of disabled persons. A copy of his attorney is placed as Annexure P-1. The respondent/Department, viz., Railway Recruitment Cell, Northern Railway has issued an advertisement Employment Notice No.1/2005 to fill up thousands of Group „D‟ posts in the Employment News (29 October-04, November, 2005). Disabilities Act is a remarkable piece of legislation for its main aim is to provide for and ensure equal opportunity, protection of rights and full participation of disabled persons in every walk of life. As per Section 33 of the Disabilities Act, the respondent is bound to reserve seats for the PH persons to the extent of 3% out of which 1% each must be reserved for the Locomotor (Orthopedically handicapped), hearing impaired and visually handicapped candidates. It is pointed out that authority the Group „D‟ posts advertised in the impugned employment notification have also been identified suitable to be held by disabled persons. In this connection, an Expert Committee appointed by the Ministry of Social Justice and Empowerment W.P.(C) No.23123 of 2005 Page 3 of 18 1.. (hereinafter referred to as „the appropriate Government‟) had dealt with the matter of identification of posts in Groups – A, B, C and D for reservation. The said Committee in its report notified by the appropriate Government vide their Notification dated 31.5.2001 made the following recommendations: (b) The nomenclature used for respective jobs in these recommendations shall also mean and include any nomenclature used for the comparable post with identical function of the identified post. (c) The establishments covered under the persons with Disabilities Act 1995 will have the discretion to identify post in addition to the posts already identified by the appropriate Government. However, no establishment on its own discretion can exclude any post out of the purview of identified post for effecting reservation under Sec. 33 of the Act. In case any establishment feels that it required exemption from filling up a vacancy against an identified post by the appropriate Govt. the establishment under Sec. 33 of PWD Act 1995 can approach the inter departmental committee constituted for the purpose to look in to the matter regarding exemption from Sec. 33 of the PWD Act. Other than this no authority has the jurisdiction to accord exemption from filling up a vacancy against an identified post for person with disabilities. (d) List of the identified jobs proposed to be notified hereinunder is in addition to an not in derogation of the earlier list published by the Ministry of Personnel, Public Grievances and Pension, Department of Personnel and Training, Govt. of India in the year, 1986. What were the 2 talking about. If they weren't' talking about someone who is considered to have a physical disability then I would agree with you. For example if they had been talking about Obama an Romney 2 people who aren't considered to have any physical disability and they said these 2 are handicapped so the people don't have a choice. If people want to think I have a handicap then that is there limitation. Handicap means limitation that is the problem. In golf you have a handicap as an example. Hello, I have seen these ads by CEAT tyers, the ad is appropriate to the context. Where the guy is crossing the road carelessly answering his cell phone and a biker just misses hitting into him. The ignorant pedestrian in turn shouts out to the rider the statement in question. This ad conveys 2 messages, that the tyres are dependable and on the other hand the ignorance of pedestrians. There is another ad which I feel really insulting to the blind community, personally hate to watch and advocate. It has the famous chef and Karate kid of bollywood, Akshay Kumar acting as the blind man who is lost and enters a bank when it is being robbed. This idiot enters the bank and asks if a particular bus leaves from there, in the process gets asulted by the bank robbers, puts on a heroic fight and gets complimented by a bimbo watching him. The compliment is Andha hai but fit hai. To which the actor replies to the bimbo, that her shirt button is open. You will be surprised what the ad is for? Well, it is for an undergarment brand. And he is advertising vests in this ad. So you see, this ad has nothing to do with the subject or comodity being advertised. But still these filthy and meaningless ads are on air because it doesn't matter to anyone on how a blind person is presented. My good friend from Mumbai, Zoher in his earlier mail, spoke about his experiences at school and specifically sighted examples of him being called names after a character played in a movie who was blind after dark. We have to just keep a watch if the matter being discussed is politically correct. From the mails and comments I read on this subject it is obvious that they are politically incorrect to compare criminals and politicians with disabled people. I have not heard the audio clip myself, Mr. Ashiq forgive my ignorance on the same. Due to other challenges with my newly acquired disability I have been very moody and selective on what to respond to and dedicate my time to. Below the photograph that was darkened in the centre was printed ‘Don't worry'. Next to it was another photograph with the Taj in all its glory, viewed presumably after treatment. Now, if you went to your ophthalmologist with a complaint that you could not see the peripheral movements and that you have to turn your head around, or that you have tunnel like vision your doctor would probably not say “Don't worry.” Instead, you might be told that you have glaucoma. And it is worrisome. For, glaucoma is a group of eye diseases which lead to gradual loss of sight. Glaucoma is known as the ‘silent thief of sight'. A person with glaucoma remains asymptomatic until much of the sight is lost. When the tear gland doesn't drain as it should, it presses on the optic nerve. The nerve is behind the eye and transmits information to the brain about the objects in front of us. The loss of sight is very gradual. Most people do not realise it until much of the sight is lost. By then it is too late. “We can only preserve what is left of the optic nerve,” said Ronnie George, director of research at Sankara Nethralaya. His team studied around 3,800 patients in and around Chennai for a period of 10 years between 2001 and 2011 and found that about five percent of them had glaucoma. Of this, five percent were blind in at least one eye. Less than 10 percent of the population screened had been diagnosed and only 12 percent of those screened knew about the disease. If you think this is a small sample study, Dr. George dispels any misconceptions you might have. The findings of the study can be extrapolated to the population. “The findings in any city would be similar,” Dr. George told me. “One in eight persons over the age of 40 in the population is at risk for the disease,” he said. Given the nature of the disease, for which there is no cure yet, the week March 11 to 17 was dedicated to raising awareness about glaucoma, the second leading cause of blindness. Awareness is so low that only 30 people attended a programme organised last Tuesday by the Regional institute of ophthalmology in Egmore a primary health centre in Porur. A screening camp was also held to identify people with glaucoma, said K. Maragadham, head of glaucoma services at the institute. “We explained about anti-glaucoma drops and told them that the drops would be provided free of cost to patients at the hospital. The drops help ease the pressure on the nerve, thus preventing progression of the disease,” Dr. Maragatham explained. The Government Ophthalmic Hospital, which is attached to the institute, gets around 150 to 200 new registrants every month besides the 350 to 400 patients who come for follow up. “If we get 100 patients in our outpatient department nearly 40 will require screening as we suspect they might be heading for glaucoma,” Dr. Maragatham said.
