Is identification of jobs good or bad?!

And, Rajesh you can't have it both ways. When some jobs are identified, 
obviously the rest of the jobs would be denied.

No, I don't quite agree.
Identification of jobs, is not, per se, bad.
It is bad when the list is used as exhaustive list and people are denied jobs 
not identified...
Such practices are resorted to without legal sanctions...

I agree with Avinash. However, this "arbitrary business" of job identification 
is not done by the Government alone. They can't dare to. It is done with the 
active support and collusion of our own people in the disability sector! 
Therefore, please find out as to who served on the Expert Committee and the 3 
Sub Committees on behalf of disabled people. It may serve as a big eye opener 
for many of you.

When UNCRPD calls for reasonable accomodation then identification
business should be abandoned.

Indian courts have shown that they are ready for progressive
interpretations of the law on the rights of persons with disabilities.
Therefore, any new law that aims to replace the Persons with
Disabilities Act, 1995, needs to be a significant improvement on it.
By JAYNA KOTHARI
SINCE 1996, when the Persons with Disabilities (Equal Opportunities,
Protection of Rights and Full Participation) Act, 1995 (PWD Act), came
into force, by far the majority of cases taken to court have been
about equal opportunity in public employment, that is, reservation of
jobs for persons with disabilities and related matters such as
promotions, identification of posts and eligibility. This struggle is
in many ways not that different from the caste and gender battles for
affirmative action in government employment. For any marginalised
group, including persons with disabilities, equality in employment is
a benchmark for full participation in society.

In Union of India vs National Federation for the Blind and Others, the
Supreme Court passed on October 8 a landmark judgment in this battle
on reservation of jobs for persons with disabilities. The PWD Act,
though a restricted statute mainly concerned with providing
reservation in jobs and seats in public employment and education, has
slowly been nudged by courts, lawyers and disability rights activists
to become far more progressive than was ever imagined. Section 33 of
the Act states that "every appropriate government shall appoint in
every establishment such percentage of vacancies not less than 3 per
cent for persons or class of persons with disability...". Section 32
requires the appropriate government to identify jobs for persons with
disability and review the list of identified jobs every three years.

In spite of Section 32, the reality on the ground since 1996 has been
that hardly any jobs were identified by the governments as suitable
for persons with disabilities. A 2009 World Bank report, titled
"People with Disabilities in India: From Commitment to Outcomes",
found that only 10.2 per cent of the posts in all
Ministries/departments and public establishments had been identified
as suitable for persons with disabilities. The situation in 2013 is
not very different. In a 2010 judgment, in Govt. of India through
Secretary and Anr vs Ravi Prakash Gupta & Anr, the Supreme Court held
that non-identification of posts could not be a reason for the
government to evade its obligation to reserve 3 per cent of posts for
persons with disabilities.

In the National Federation for the Blind case, the core question was
whether the 3 per cent reservation should be calculated on the basis
of the cadre strength or the number of vacancies in the identified
posts. Cadre strength refers to the total number of posts in the
cadre. At present, if at all reservation for and appointment of
persons with disabilities are made, it is only on the basis of the
vacancies that arise in "identified" jobs, which are far fewer than
the total number of posts in the cadre. The Supreme Court held that
from a bare reading of Section 33 it was clear that the intention of
the legislature was that the 3 per cent reservation was computed on
the basis of total vacancies in the cadre strength. This
interpretation is significant as it will lead to an unprecedented
increase in the number of appointments in State and Central government
jobs for persons with disabilities.

One of the most interesting observations of the court in this judgment
pertains to reservation in the private sector. Section 41 of the Act
states that incentives should be given to public and private
establishments so that they provide 5 per cent reservation for persons
with disabilities. The Supreme Court held that "on a conjoint reading
of Sections 33 and 41, it is clear that while Section 33 provides for
a minimum level of representation of 3 per cent in the establishments
of appropriate government, the legislature intended to ensure 5 per
cent of representation in the entire workforce both in public as well
as private sector".

This expansive observation of the court has gone unnoticed amid the
excitement over its statement on reservation based on the cadre
strength. This opens up new avenues for implementing reservation for
persons with disabilities in the private sector as well. This
opportunity was passed up by Justice Ravindran in the judgment in
Dalco Engineering Pvt. Ltd vs Satish Prabhakar Padhye & Ors, which
stated that the definition of "establishments" under the PWD Act did
not include private companies. Now, however, the full Bench of Justice
P. Sathasivam, J. Desai and J. Gogoi has clearly moved ahead by
observing that the intention of the legislature was to ensure

I agree to Mahesh sir.
Let us forget the bitterness now. and collectively work for better RPD
after polls.
Javed sir I gracely apologise publickly if my way of asking and posing
issues have hit you hard. But sir you should understand many landmark
judicial pronouncements and interests of fairly population of disabled
were at stake if this Bill had been passed in its current form.
My commitment to healthy academic discourse has always inspired me to
study and react to all sides of the discourse. Access India has
witnessed my postings from all perspectives on RPD in the last few
weeks. But being myself a totally blind researcher on India's
disabilities act who has easy access to media and academia didin't
wish this Bill be passed where totally blind/low vision  persons were
intentially ignored and marginalised in the Bill. And other disabled
categories also rightfully objected to the Bill as you know from the
writings of Amba Salelkar, Professor Mustaffa of Nalsar,  Jaina
Kuthari of Alternate legal firm banglore and others.
And as far as activism and leadership is concerned I must talk about
two researched writings one by Meenu Bhambani's  who submitted her MA
dissertation praising Mr Javed's contribution under the banner of DRG
and Dr jagdish Chandra's  PHD theses who primarily discusses Mr Rungta
and NFB's activism on ground since 70s.
Finally friends, we shouldn't forget this fact whosoever handles media
successfully his'her version gets documented an then that report and
bite can be referred in future. And Mr Javed is superb in dealing with
news agencies. Both leaders have played major roles but there has
always been lack of trust and coordination.
NFB should certainly embark on opening research cell to produce
quality reports and findings this is the lesson they should take from
this RPD fiasco. And finally, I will always be indebted to Mr Rungta
sir for making this hiddened Bill publick so that the lives of million
people have been saved and there is huge possibility to rectify the
provisions of the Bill in conformity to UNCRPD. Disability has
countless shades and frankly writing we don't understand each others
so all groups should be represented.

I agree with Avinash. However, this “arbitrary business” of job identification 
is not done by the Government alone. They can't dare to. It is done with the 
active support and collusion of our own people in the disability sector! 
Therefore, please find out as to who served on the Expert Committee and the 3 
Sub Committees on behalf of disabled people. It may serve as a big eye opener 
for many of you.

Shri S. K. Rungta is someone who has been involved in disability
activism from the 1970s at least, that is before many of us were even
born. He has done a lot of work for the community, including some
important and famous judicial victories and very recently, leaking the
obnoxious secret dossier of the government. Mr. Rungta was not the
only leader of the community who was against passing the bill in its
present version. The concerns expressed were legitimate. So there is
no point attacking him in person. There may be differences of opinion
with his perspective, but the decades of activism certainly deserve
respect.
That brings me to Shri Javed Abidi. He too has done significant work
for the community, has worked to bring together different sections of
the community and has his fair share of achievements. He had his own
logic for demanding the passing of the bill in the present format with
certain amendments. But it is just that many of us were not convinced
with that. As a proclaimed cross disability activist, I doubt whether
Shri Abidi correctly gaged the extend of concern that this bill
generated among certain sections of the disabled. A cross disability
platform, as he should know very well, is about building alliances
where different concerns are understood and accommodated. This session
being the last of this Lok Sabha, and with the kind of concerns that
the bill gave way to along with the very suspect actions of the
government, resulted in a lot of emotionalism in disability movement
in recent times, mistakes may have been committed from different
sides. But now that the bill is refered to the standing committee, we
have to get over this face of emotionalism and come together so that
we can have a meaningful and substantive legislation.
I would urge shri Abidi to forget the bitterness if any and get back
to the coalition building mode that would include everyone. The
language of sarcasm and challenge may not be the best way to do it I
believe.
As for many of our Access India community members, the feeling that
our legitimate concerns were getting ignored resulted not just in
solid and strong face of activism, it also has given rise to a lot of
emotional reactions. But now its time we think of the broader
scenario. There is a war to be won out there. We can't have pitched
battles and friendly firing inside our own camp. There was a genuine
difference of opinion and approach with Mr Abidi and certain others.
That difference has been expressed, there is no need to get so
intensely and rather viciously personal.
Lets have a civilized engagement from both sides.

[AI] Need help for purchase of a CAR

Manager, I want to purchase a new CAR for self driving purposes but i do
not know which one is good for me and will i drive the CAR or not.

I am surprised about lack of sensitivity at heathrow. In my opinion, the 
security staff at heathrow are the most polite and sensitive about disability. 
Of course my observations are purely from a visual impairment perspective. But 
this also emphasizes the need for regular refresh of training about disability 
awareness. A lot of organizations do have disability awareness training when an 
employee is inducted but this training is not reinforced on a regular basis. So 
when confronted with a disabled customer, they may or may not remember their 
training.

DEKH”: Season 3, India’s only
radio show on issues pertaining to all disabilities on 17 All India Radio
Stations, every Wednesday starting 26th
February 2014. 




Hindustan
Petroleum Corporation Ltd. (HPCL), as a part of their CSR, is supporting this
8-Part Radio Program.




 This radio program
will feature various aspects and issues related to disability in India
involving the following aspects: Education, Gender, Sports, Livelihood,
Access, Technology, Performing Arts and the ‘Rights of
Persons with Disabilities Bill 2014’ recently introduced
in The Rajya Sabha. 




Trinayani’s founder,
Ms. Ritika Sahni, who will host the show, will invite experts, activists
and dignitaries in the field of disability, to share their thoughts. 




We will continue with
our campaign for DISABILITY AWARENESS as on the past two seasons of this radio

There is a currency checker with the Saksham in Delhi.  Or you can
prepare it by yourself.  Simple.  Cut papers equal to the size of each
currency and pin it together.  Place the currency above  this device

to learn math, u can use "mathtrack software". its an open source
software. you can use other two  application "vp arithmetic " and "vp

Dear Friends,

Till very recently I was proud of the fact that accessindia is a group
of educated blind people and have always thought that we will argue
but never abuse.  I am afraid I have been proved wrong this time.  I
cannot understand what will be achieved by abusing an individual or a
group of individuals.

I think the issues are more important than any individual and we ought
to concentrate on the issues.  Now that the bill has been sent to the
Standing Committee (unless we get the ordinance) we must discuss about
lexities in the bill and work towards reducing or getting them out.
Please stop people bashing.  Let us argue on points and now that all
of us are on the list, let us have a fruitful and healthy debate.

Though I completely sympathise on the issue, in this particular case, I cannot 
blame authorities too, because the particular day when Mr. Singh was traveling, 
there was a high alert at the airport due to a threat they have received. So it 
must be due to that officials did not behave correctly. 

For a few months now I have noticed a much sensitisation among officials and 
airline staff. In my recent travel to Delhi along with a totally blind girl, 
security guys helped indeed. 

Overall there is an improvement but we see some instances such as what Mr. 
Singh has faced. But I realised that with appropriate communication, we can 
overcome. 

One thing that really needs improvement is that post security check airline 
line staff make us sit somewhere saying that they will comeback when boarding 
is started but I have seen several instances that they forget.

George,Taking off from where you left off, we will have to deal with the
government and the various other lobbies that are going to now have a chance
to dilute the Bill. Do we really think that we the Disabled are the only
stake holders who are going to get a hearing before the Standing Committee? 
We now have to prepare for the next part of the battle which is going to be
tougher than what we have seen so far. 
Access Indians must concentrate on winning the match instead of running your
team mate out. 
The delay in enactment may not be considered by many to be important on the
threshold of getting a better law but to justify this  we will all have to
sort out our priorities and take ourselves forward without rancor.

to think of what we can do collectively to get a great bill that works for
all. Venting anger on Javed to my mind is a waste of time. 

Further in any movement, people come to table with different approaches and
we need to respect the diversity in views and take on the best that works
for the group. My considered view is that all of us are in the same team
and let us keep the team together as we battle the main foe which is the
Govt.

NEW DELHI: Yet another disabled passenger was harassed at the airport on
Friday. Satendra Singh, who was travelling from Hyderabad to Delhi, was
asked by security at Hyderabad's Rajiv Gandhi International Airport to
remove his leg brace during frisking. Singh, who teaches at the University
College of Medical Sciences, Delhi University, has post-polio residual
paralysis and uses a knee-foot-ankle-orthosis (KFAO) also called a caliper
or brace, for support. 

 The confrontation with security officials - the latest in a string of such
encounters between differently-abled passengers and airport officials -
lasted about 20 minutes before the officials capitulated. "They wanted me
to remove the caliper and run it through the x-ray machine," says Singh,
"In my case that's quite difficult as it goes up to the thigh. I would've
had to remove my trousers to take the caliper off. It was humiliating. I
wanted them to carry out an Explosive Trace Detector (ETD) test and was
willing to let them frisk me." 

 Singh, ironically, was returning from a conference on "Evidence in Global
Disability & Health" in Hyderabad. Employees of the airline were also
called but a senior officer finally permitted a ETD. Singh also had to
explain that what he uses isn't a prosthetic limb but an orthosis into
which he has to place his leg for support. 

 "We are merely implementing guidelines issued by the Bureau Civil Aviation
Security (BCAS). Our officers have been trained and briefed on how to deal
with differently-abled passengers and we make sure nobody is harassed
unnecessarily," said Hemendra Kumar, spokesperson, CISF. Singh, however,
adds that he flies within India frequently but has never had to face this
before. 

 Aviation security officials say people with medical implants won't face
any trouble and simply need to show a medial certificate. However, there is
no standard rule for those with external aides and a doctor's certificate
may not be enough to clear security. 

 "The screening officer has to be satisfied that the external aides are for
genuine use. For this, profiling is done and if the screening officer is
not satisfied, he or she may ask for the aides to be taken off and
screened. In the 1980s, a Delhi-Srinagar flight was hijacked by a person
who hid weapons inside his plaster and carried a doctor's certificate for
the same to clear security. We cannot take chances as a medical certificate
can be easily obtained. We regret the inconvenience caused to anyone," said
an official.

organisation can not run far 40 years with only 6-7 people. I am of the 
opinion that totally blind and mentally retired people were always denied to

domain, the passing of this bill would have done an immense damage to
the  very interests of the disableds.
3. why did you not try to seek a copy of the bill from the government?

I have found the in-built keyboard the best. Firstly, it is the standard one 
approved by the Government of India. Secondly, it is almost the same in all 
the Indian languages. For example, I found the Hindi keyboard quite similar 
to Gujarati keyboard.

its handy at times for a very small use.

Let them abuse me, Srinivasu. You and Harish need not worry. 

I also want to see as to what depths these 6-7 individuals can fall under the 
able guidance of their great leader Mr. SK Rungta.

Some pertinent questions have been posed to me. They were posed earlier also 
but I could not reply then due to a genuine paucity of time. But now I can and 
I will respond.

So, my message to Neelima & Company is to curb the hysteria. In a day or two 
(as soon as I find some time), I will definitely send you a elaborate response. 
Just relax and be patient.

Shanti Auluck's home in New Delhi with their sons, keen at first to
arrange a marriage with her daughter in an age-old Indian custom.

But with each visit came apologies and a change of heart. All of the
families were turned off by the fact Auluck also has a son with Down
Syndrome.

"There was this feeling that somehow he might have a negative impact
on them, that he might rub off on them. There's a lot of ignorance
about disability," Auluck told AFP.

Finally Auluck, a mother of two and a doctor of psychology, learnt to
choose her words carefully.

"I'd say yes I have a son. He has a job but he can't go into
academia," said Auluck.

For the 40 to 60 million people with mental and physical disabilities
in India, discrimination and stigma are daily battles. In a country
where social standing -- including through marriage -- is all
important, having a disability often means being relegated to the
bottom of the pile.

"A lot of families keep their disabled children behind closed doors
because they are embarrassed," said Auluck, director of Muskaan, a
training and work centre for intellectually disabled.

A long-awaited bill introduced into parliament this month aims to give
more disabled people equal rights -- including access to education,
employment and legal redress against discrimination.

Sonia Gandhi, head of the ruling Congress party, has promised disabled
groups the landmark legislation will be passed, seven years after
India signed the UN Convention on the Rights of Persons with
Disabilities.

"This is a game changer," disabled rights leader Javed Abidi told AFP,
after one of the many protests and candle-lit vigils held in Delhi in
recent weeks by thousands of disabled to pressure politicians to pass
the bill.

But others fear the well-meaning bill, even if it is passed, will make
no difference to the way in which the disabled are treated, in a
country where many existing laws are poorly enforced and often
flouted.

Disability a 'curse of God'

Attitudes against disabled people, particularly women, are deeply
entrenched, especially in poor rural areas where families are already
struggling to make ends meet and social services are few.

"This whole scenario makes her more vulnerable -- she is treated as a
burden in the family, as a result domestic violence and sexual abuse
is rampant," said Shampa Sengupta, who has worked with the
intellectually disabled in the eastern city of Kolkata for 25 years.

"Both at family level as well as the outside world, people think she
is dependent," said Sengupta, who herself battles chronic depression.

As a result, forced sterilisation of women, particularly ones with
intellectual disabilities, are still common, along with forced
abortions for those who do fall pregnant, Sengupta told AFP.

In some cases, a disabled woman is married off to a man who is also
"given" the woman's sister as a bride, as a way of smoothing the deal
and as a favour to the over-burdened husband, she said.

Police are less likely to treat cases of sexual assault against
disabled women as seriously, said Sengupta, who is currently helping a
family whose blind 14-year-old daughter was raped, allegedly by a
neighbour.

"There is a perception that disabled girls are worth less so they are
given less attention by police. Others are very sympathetic, offering
her sweets and saying 'poor girl.' But that doesn't mean her case will
be treated in the same way (as others)."

Last chance for bill

Activist Abidi, born with congenital spina bifida and confined to a
wheelchair, agrees more education is needed to change attitudes. But
he said the bill was crucial to empower the disabled to take action
themselves to correct society's misperceptions.

"This is the start of something. The bill may not be perfect, but
nothing ever is, and we are not going to get this chance again," said
Abidi, referring to looming general elections that are likely to see
the left-leaning Congress party booted out of power and the bill
dropped.

Millions more people are classed as disabled under the bill, including
those with autism and multiple sclerosis, which entitles them to
government benefits. These disabled can also use the bill to fight
discrimination across all areas.

"It means people with mental disabilities in particular have the right
to hold a job, have the right to open a bank account and no-one can
tell them 'no' because of their disability," said Abidi.

Some disabled groups opposed the bill, which would replace a 1995 law,
saying it has been watered down from earlier draft versions.

But Zorin Singha, who was born deaf, said the current paper was
"perfect" for the country's 18 million hearing impaired, including
making captions or sign language interpreters available for all
electronic media.

Have you tried scanning it with a good antivirus?

Actually, I also had the same problem and I had to format the flash drive.
I recovered the data of the drive with the help of a good recovery software.

[AI] Problem with memory card and pendrive, request for help, please!

Dear All,

Yesterday, my memory card and pendrive got infected by virus and I'm not able 
to access the contents.  There's only one file in the memory caard, USBC. And 
the pendrive also has only one file called 15GB.  It is apparently a shortcut.  
But it is not opening.  There's a message coming that the dll file is missing.

Both the memory card and the pendrive contain data collected over the last four 
years.  These include images, videos, softwares, books and text files in 
English, Telugu and Hindi on more than hundred topics.

In view of the above, please share your expertise on how to access the content 
contained in the two USB storage media.

mr. Abidi is already answerless because he has done compaign for  anti
disable bill. being a disable activist, he  leaded the disability
distruction bill.  even he has spoken the congress political language.
like R.p.d. is giving us reservation from 3 to 5. it has lot of
catagories etc. but being description  of several  newer disabilities
it has no any kind of releaf for those who were getting included and
who are already existed in the list. Now need to fight to
implementation of supreme court verdicts on the p.w.d. act.  mR. Abidi
my request  you to talk to congress/government of india and ensure
this court verdicton p.w.d. if you will do it then I will be happy and
accept you as disable activist. now you are only facebook disable
activist.  please show your strength.

in built keyboard is good to use. But I have a doubt that when we give
any test of typing in any government exam what keyboard layout will be
given?

A good news as today Bank of Baroda has shared with Talking ATM India
website addresses of total 168 Talking ATMs installed by bank.  This is a
great step by Bank of Baroda and help to us in building Talking ATMs
database.  We are grateful to Bank of Baroda for installing Talking ATMs
for the blind in many parts of the country.

We hope similarly State Bank of India will response soon as they have 3000+
Talking ATMs.

We are happy as things are progressing and this website is helping our
community.

We welcome your suggestions, feedback, test results and support.

To Sadguru - thanks for pointing out one small database issue.  We have
fixed it and now you can see Burari location when search using by area.

We are very thankful to Harish Kotian as he is supporting us with
improvement points regularly.  We will surely work on them. Thanks to all

Voice Vision Scholarship 2014-15

Voice Vision takes great pleasure in announcing its scholarship for the
academic year 2014-15! 

Voice Vision scholarship is a financial assistance which would be offered to
a deserving undergraduate visually challenged person who has completed his /
her class 10th (SSC) and is pursuing higher studies (Graduation or Diploma
from a recognized institute) in India. The aim of the scholarship is to
facilitate the deserving student to pursue the career path of his/her
choice. 

Eligibility criteria: 

Candidates applying for the Voice Vision Scholarship should fulfil the
following criteria. 

. Candidate should have secured 60% marks or more in class 10 or 55% marks
or more in class 12. 
. Candidate should have passed class 10th in the academic years of 2011-2012
or 2012-2013. 
. Preference will be given to students pursuing unconventional career paths
such as BMS, BBA, BMM or physiotherapy, journalism, dietician etc. However,
other needy and deserving students from conventional streams would also be
considered. 
. The candidate should be visually challenged (Blind / low vision). 
. The annual family income of the candidate should be less than Rs.
2,00,000. 

Application Process: 

Interested candidates who fulfil the eligibility criteria mentioned above
are requested to either fill the prescribed form online or download and
print the form and attach with the below mentioned enclosures and send to us
by post/hand delivery/courier to the following postal address,

Dear Suman,

At the outset, let me clarify that I am a regular user and contributor to
NVDA. I think it is a great screen reader and has made tremendous strides in
the last couple of years.

Having said that, switching your screen reader just to avoid automatic
updates seems to be a bit of an extreme step. I also think statements like
"NVDA is as good as Jaws" are very highly subjective and maybe construed to
be incorrect. NVDA performs well for some tasks such as support for Firefox
whereas Jaws has its own strengths such as much better support for calendars
in Outlook and so on.

I appreciate that you are trying to promote the use of NVDA which is
admirable but I suggest that you do this using facts and not highly
subjective statements. Thank you for your consideration.

 Phonnetic keyboard means, If you happen to type kaisayHo, in english, 
AIt will provide the similar sounding word in Hindi in Hindi letters. कैसेहो!

[AI] Important issues need to b address in rpwd bill

Friends,  this is in reference to what i wrote in the conversation on the said 
bill, an important issue which the said bill has not address is that person 
working with arm forces get disable specifically looses sight in due discharge 
of his non battle duties, he or she send rather asked to take retirement from 
job,but probisions b made where he b adjusted in inactive duty or his expertees 
b taken in other  public sectors,  or Govt. Dept. Or govt. Undertaking 
sections, a person  who lost sight on job in services while on non battle duty, 
was asked to retire, but he is contesting  legal case in mumbai high court to 
seek his job back,, certain provision b made in the bill to provide job 
scuirity to such officers, person, the clause regarding the electronic material 
like webb site etc. B blind friendly not clear, another issue which needs to b 
address that person who fall in to group "a" class 1 Govt. Job, & are not in to 
all india level  b given exsumption from transfer posting,, as thi
 s is relevant in hilly states of uttarakhand, himinachal pradesh, & some other 
northeasten states, where maximum stations are not even have favourable 
conditions for sighted, abled person, then  what to talk of disables, though 
central Govt. hrd+ social justice ministries guide lines are there in this 
regard, but they are not legally binding, result  concern person is forced to 
take legal remedy, = fight case in courts, so therefore strick laws b framed in 
this regard, more teeth b given to handicap commission in protecting interest 
of disables, i would request harish, kiran to consoledate the views of other 
members on this list,& forword rather put forword in form of representation   
on behalf of access india to the concern athority or ministry, or later to the 
newly elected members ofloksubha, or for that matter the exsisting members of 
rajya subha so that needfull attention is paid to the said draft, + request my 
fellow friends to voice their views on above mentioned subjects, th
 en incase the bill takes shape of ordanence then also the next Govt. In office 
in june can surely incorporate rather address left out issues, hoping to hear 
from my fellow friends so that i b enlightened + best could b done in
