[AI] Income Tax Exemption for Disabled Employee for the financial year 2009-10
Dear All, As requested by earlier messages, i am producing herbelow the new link of income tax exemption for the financial year 2009-10, further please read the para about exemption as : I. Under section 80U, in computing the total income of an individual, being a resident, who, at any time during the previous year, is certified by the medical authority to be a person with disability, there shall be allowed a deduction of a sum of fifty thousand rupees. However, where such individual is a person with severe disability, a higher deduction of one lakh rupees shall be allowable. Every individual claiming a deduction under this section shall furnish a copy of the certificate issued by the medical authority in the prescribed form and manner along with the return of income, in respect of the assessment year for which the deduction is claimed. In cases where the condition of disability requires reassessment of its extent after a period stipulated in the aforesaid certificate, no deduction under this section shall be allowed for any subsequent period unless a new certificate is obtained from the medical authority in the prescribed form and manner and a copy thereof is furnished along with the return of income. For the purposes of this section, the expressions disability, medical authority, person with disability and person with severe disability shall have the same meaning as given in section 80DD (sub-para E of para 5.4 of this Circular). Dear Tushar, Thank you for writing to me, i know the difficulty were deaf persons facing in concessions at indian railways, however i have made several representation to set right the defects in concessions for deaf persons, no-one is bothered to set right the defects yet to now, but President of India's Secretariet has send directions to ministry of railways to do the needful about my representation to imliment railway concessions to deaf only also. As existing railway concession pass is applicable together for deaf dumb, hence separate concession for deaf only or dumb only we must need. It also take note that some one having deafness and otherone having dumbness, then how one who insiste for affixing together i.e. deaf dumb ? This is discrimination and attracts unequality among disability. Dear Janardhan Naidu, As we know when DOPT issued circular during 1998 having promotion reservation to physically challenged employee in all grades,all groups, but subsequently it state to be superseded vide circular issued during 2005, in recent verdict at Division Bench of High Court of Karnataka it opinion that DOPT issued circular during 2005 is merely an instruction it does not disclose promotion reservation, hence it further ordered that when petitioner approaches high court then it certainly send direction to government of india to implement promotion reservation in all government establishments, hence we await further development in due course.
