Hello friend

Actually there is no universal guideline exist regarding the extra
time and scribe eligibility for visually impaired candidates during
the examination.

1   Every state has different provision regarding this.
2   Different universities and other exam conducting bodies interpreted
the recommendations in different way and made their in practical
rules.
3   In fact UGC also doesn’t have the clear provision regarding the
extra time for visually impaired candidates in the examination, which
enforce to the all universities and other educational bodies
affiliated by UGC.
4   That’s why Different universities have different rules regarding the
extra time and eligibility of scribe.
5   This is not ends here different state’s recruitment agencies have
different views in this regard and have no clear cut provision.
6   Many high courts made judgments in this regard but other state
bodies disobey verbally.


The above facts is per my knowledge, if I am wrong in anything senior
and knowledgeable members please for give me and correct me.

Sazid I can understand your anxiety and the problem you would have suffered.
Due to this lack of awareness even among the people who are sitting on
the higher authorities.
But don’t get dishearten with these occurring witch are bound to
happens with us.
In this particular case I would advise you to take this grievance to
the appropriate place, either you can reach to the education
department based on your district it self or pursue this matter via
any NGO who would be active in disability field.
There can be other mechanism as well but I don’t think they will be
feasible in your case, meaning filing an RTI or dragging concern
officials to the court of law.
Apart from it you can file an online complaint form over HRD ministry site.
But it would be better to take this issue step by step, I mean first
of all on local level itself and then if not redress then Higher
authorities.
Here I would also like to clarify that there are appropriate guideline
for the extra time provided for VH candidate in all examinations
whether it is academic or competitive exams.
UGC, Banks, Education departments etc. everybody have now proper
directions through circulars to insure mentioned extra time duration.
The thing is that you should obtain those circulars,
And for the benefit of your and others most of the required circulars
related with the visually challenge are available on
‘inclusiveplanet.com’.

As per my knowledge and also confirm by a good NGO, there no such
circular exist for extra time in examination by UGC. If you have
please provide the same, which helps to lots of visually impaired
candidates.

evaluation the marks for diagrams will be compensated by the written 
explanations.
 
25. Each examination authority to assign within its existing system an officer 
on special duty who will be exclusively responsible to processing requests of 
students with special needs and addressing concerns, providing services and 
ensuring appropriate implementation of these rules. The contact information of 
the said officer need to be published in all application/admission forms, 
brochures, website, directories and any other suitable places. The said officer 
needs to be appointed at the examination centre/district/state level as per the 
existing system of the examination body. (Question for consideration - How 
better can we suggest this system?)
 
26. Question for consideration - Still to be debated - make practicals as 
stated above or VIVA? Viva up to 10th/12th standard and accessible practical as 
mentioned above for higher standards?
 
27. Question for consideration - FEES OF WRITERS? How much? Who is to provide 
this? Compulsory or optional?
 
28. The said guidelines will be reviewed on a 5 yearly basis to keep up with 
new technologies and services available in the field as also advances in the 
educational systems. The review will be conducted by the Ministry of Social 
Justice and Empowerment in consultation with all relevant stakeholders.

Do you have the Government order about which you have told the DEO?

I'll advise you to go through the advertisement issued for AP Teacher
Eligibility Test. There should be some guidelines regarding VI,
scribe, and extra time. If no such clause exists, the notification is
bad and it could have been challenged prior to the exam only.

If the guidelines are there and have not been followed, you can give
the representation to the higher officials of the department
requesting to take the disciplinary action against the concerned
examiner, DEO, and director. They are responsible for “Dereliction of
duty” and “misuse of power.”

Good evening Access Indians,

I hope all are doing well.
Sorry to say this. The same thing happened to me today.
Today, I appeared for Post Graduation in Law Common Entrance Test in
the state of Andhra Pradesh.  Last week, I went to the University and
explained my disability to them and I requested them to allow me to
bring a Scribe on my own. But, the University authorities told that no
need to woory, we will arrange a Research Scholar to appear as a
Scribe for you.
Today, when I went to the University, they arranged a Scribe to write
my entrance exam.
But, the person who appeared for me as a Scribe was not able to read
out the legal terms properly. First of all, he was not able to read
the general terms properly and then about legal terminology.
They gave the question paper 3 minutes late and the person who
appeared for me as a scribe did not show much interest to read the
questions fully. When I ask him to repeat the question, he told that
you have to bring a Scribe on your own and it is very difficult for me
to write your exam.
In the middle, he wasted 10 minutes for tea break and for drinking
water. He attended his phone calls also.
When I ask him to spell out the word to understand, he started shouting at me.
At Last, due to his negligence, I am not able to attend 5 questions
and more over, the University authorities refused to give me extra
time.
I worked hard to appear for the exam. But, all my efforts had gone
waste. I have no satisfaction regarding my performance in the exam.

Today, when I went to the University, they arranged a Scribe to write
my entrance exam.
But, the person who appeared for me as a Scribe was not able to read
out the legal terms properly. First of all, he was not able to read
the general terms properly and then about legal terminology.
They gave the question paper 3 minutes late and the person who
appeared for me as a scribe did not show much interest to read the
questions fully. When I ask him to repeat the question, he told that
you have to bring a Scribe on your own and it is very difficult for me
to write your exam.
In the middle, he wasted 10 minutes for tea break and for drinking
water. He attended his phone calls also.
When I ask him to spell out the word to understand, he started shouting at me.
At Last, due to his negligence, I am not able to attend 5 questions
and more over, the University authorities refused to give me extra
time.
I worked hard to appear for the exam. But, all my efforts had gone
waste. I have no satisfaction regarding my performance in the exam.
Now, I will not get the desired result which is necessary for me to

Yes, I approached an NGO regarding, things are going on.  He asked for some 
G.O's.  I request list members to provide the AP G.o's as well as central 
G.O's.  Which will help them to workout.
 
In my view fighting for a right alone is very diffficult.  I request any Blind 
association will take this step.
Onethinng I am not understanding why should we beg or fight for the right which 
was provided by the constitution.  Are we enjoying the fruit properly in our 
daily-life.  Why there is negative point on us, manytimes i was vexed on the 
society.

good morning Pranav sir,

Actually I opted for the nearest University which will be convenient
for me as well as my parents. But, things went beyond my expectation.
Anyway I will opt for some other University.
But, I will not leave it. I will keep fighting for the rights of the disabled.
One more thing which I have understood from the behaviour of
authorities is that differently abled people will not prepare well for
exam and they depend on the Scribe for answers. When I told the
answers, the Scribe is cross checking my answers. He is not from legal
background. But, he is saying that my answer is wrong. At last, I lost
my patience and said him that
“I am the gold medalist in law. So, you no need to worry about the answers”.
First of all, we have to prove that differently abled people are also
talented and hard working. We have to bring awareness in the society.
Unless we educate the authorities, none of the rights are useful for
us. So, the first thing what we have to do is that we have to bring
awareness.
That is the solution for this kind of problems

You have to bring it to the notice of the Commissioner, Disabled welfare
Hyderabad.

dear shaik,
as another member replied earlier, you have some wrong perceptions and wrong 
actions. as they said, there is no government order or any universal law 
binding all examining authorities in the country. all that is there is a 
model guidelines prepared by the ministry of social justice and empowerment 
if I am not wrong. these model guidelines are only suggestive and not 
imperative for the examining authorities. each examining authority makes its 
own rules in the matter which are applicable to only specified exam or exams 
conducted by that authority.
there are number of communication and other gaps between and even within 
departments. since no binding law, the question of these gaps, the arrivals 
of the orders to the departments does not arise at all.
well you could have taken some precautionary steps to avoid this. instead of 
asking for extra time in the exam hall, you could have studied thoroughly 
the examination rules issued by your recruitment authority. if the rules 
were unclear, silent, or not available to you or if they would be 
detrimental for you, you could have written to the top officer of that 
recruiting agency for an urgent action. regarding the scribe also, you could 
have done the same thing. you could have enquired about the qualification, 
language and writing ability, knowledge of how to pronounce technical terms 
and notations of your subject. also, you could have negotiated the 
possibility of taking a speed test of the scribe. all that is gone. please, 
all the members, check such things well in advance before attending any exam 
in future.
now, as per my knowledge, the only option left is to make a complaint to the 
state commissioner of persons with disabilities and seek for a remedy. but, 
that is also not sure. and for your information, there is no rule stating 
extra time cannot be given in competitive exams. whether it is academic, or 
it is competitive exam, the problems of the VI are the same. and I have seen 
some exams like UGC NET and Karnataka Gazetted Probationers' exam, (KAS) 
where extra time is given in competitive exams. wish you all the best for 
your future.

After becoming VI this is my second exam, so that i do not know what are the 
do's and dont's.  As you told me to prepare well I had prepared well.  The 
first competitive exam which I appeared was RRb on may 6th in that they 
provided extra time.  As you shoot a mail that 60% was withdrawn from RRC but 
in their latest notification RRC "special recrutment drive for disabled they 
clearly mentioned that the scribe should be not more than 60% which was 
announced on 9th june, 2012".
 
When the guidelines are prepared by the social justice department why are they 
keeping that guidelines wighwith  them.  According to IPC 420 section it is 
applicable in all over india.  Why cant the guidelines applicable all over 
india.  My intention is not to beg extra time.  As I am not aware of the scribe 
so that I did not meether.  I am sorry if hurt.  I had given met Assistant 
Director for disabled to look into this matter.  Yes, practise makes men 
perfect.

as another member replied earlier, you have some wrong perceptions and wrong 
actions. as they said, there is no government order or any universal law 
binding all examining authorities in the country. all that is there is a model 
guidelines prepared by the ministry of social justice and empowerment if I am 
not wrong. these model guidelines are only suggestive and not imperative for 
the examining authorities. each examining authority makes its own rules in the 
matter which are applicable to only specified exam or exams conducted by that 
authority.
there are number of communication and other gaps between and even within 
departments. since no binding law, the question of these gaps, the arrivals of 
the orders to the departments does not arise at all.
well you could have taken some precautionary steps to avoid this. instead of 
asking for extra time in the exam hall, you could have studied thoroughly the 
examination rules issued by your recruitment authority. if the rules were 
unclear, silent, or not available to you or if they would be detrimental for 
you, you could have written to the top officer of that recruiting agency for an 
urgent action. regarding the scribe also, you could have done the same thing. 
you could have enquired about the qualification, language and writing ability, 
knowledge of how to pronounce technical terms and notations of your subject. 
also, you could have negotiated the possibility of taking a speed test of the 
scribe. all that is gone. please, all the members, check such things well in 
advance before attending any exam in future.
now, as per my knowledge, the only option left is to make a complaint to the 
state commissioner of persons with disabilities and seek for a remedy. but, 
that is also not sure. and for your information, there is no rule stating extra 
time cannot be given in competitive exams. whether it is academic, or it is 
competitive exam, the problems of the VI are the same. and I have seen some 
exams like UGC NET and Karnataka Gazetted Probationers' exam, (KAS) where extra 
time is given in competitive exams. wish you all the best for your future.

On this day Andhra Pradesh government was conducted AP Teacher Eligibility 
Test. In the exam hall I asked the examiner to provide me extra time for me. 
the examiner advised me to talk with district education officer. after half an 
hour DEO visited my room I told him about my concern. He contacted the 
direcctor and refused me to provide extra time. He told me extra time is only 
permisible in acadamic class only not for competetive exam. I was schocked 
after hearing the news from an officer who is a District incharge for education 
department. Is it true extra time is permisible only for central government 
exams and academic exams?

Due to this distrubance I could not write the exam properly and I had not given 
extra time. I told the DEO that there is Government order which is applicable 
for all over the India. But he is not ready to take my point. Another thing is 
that class X student was provided as scribe for me. She was not having fluency 
in reading telugu terminology as well as phsycology terms. So it took lot of 
time to understand a question.

What should I do regarding this issue.

How should we educate District officers? Does the government orders reaches the 
officers? Will through the orders into dust bin? Is there is any communication 
gap between disability department and various department?

hello sheik,
since this is your second exam, you were not aware of the possible 
situations. right, but be careful in future as many such uncertain times may 
come. there are several laws concerned with disabled which are vague in 
nature. be skeptic in all aspects of such provisions and confirm every thing 
well in advance. by preparing well, I meant to look after these issues also. 
I hope you prepared well for your exam and you will. but we have to give 
equal attention and some times even more attention to these issues while 
before examinations.


as I saw, IPC 420 speaks about Cheating and dishonestly inducing delivery of 
property and is in no way connected to the case. how did you got a 
connection with the section? can you explain in detail? the guide lines 
though prepared by the ministry of SJ and empowerment, will have binding 
effect only if they issue them with the authority in the form of a 
government order, gazette notification, or enactment. but these are just 
draft guidelines which do not have any legal strength.


I never said, and never will say you are begging for extra time. you need 
not say so. it is your moral right. only thing is to make it legal right 
through some enforcing rules. even with known scribes we need extra time due 
to some extra time wastage in communication. with unknown scribe it is even 
more. it is good your following it up with the authority. but, make sure 
that they are not protecting their subordinates. if at any time you feel 
that they are not acting as expected, don't hesitate to go to the 
commissionerate for the persons with disabilities or any court of law.


one more suggestion, it is not related to the present topic, your message 
contains many spelling mistakes which makes it difficult to understand. I am 
not intending to discourage you, and please take this in a right spirit. I 
am saying this just because the communication is important. as I observed 
the patterns of errors in your mail, I think it is due to unknowingly

do's and dont's. As you told me to prepare well I had prepared well. The 
first competitive exam which I appeared was RRb on may 6th in that they 
provided extra time. As you shoot a mail that 60% was withdrawn from RRC but 
in their latest notification RRC "special recrutment drive for disabled they 
clearly mentioned that the scribe should be not more than 60% which was 
announced on 9th june, 2012".

Thank you for your valuable suggestions.  As concern to IPC  that Indian penal 
code is applicable all over the India, why can't the guidelines applicable all 
over India.
 
Thank you for rectifying me.  As on that day my baby was distrubing me that is 
the reason lot of mistakes and spelling errors occured.

sorry for the late reply but I thought of giving some clarifications.
hi Muhammad,
I think in such cases, pursuing the matter at district level is not a good 
idea. better it be fought at the state level since the erring official 
himself is a district officer and I think the problem is also with state 
level officers.


filing an RTI application can be done only to obtain the information and not 
for grievance redressal or any type of such legal fights. you can only use 
it as a prelude to get the info you need for your battle. but RTI itself 
cannot give you solution. remember: you cannot even seek for interpretation 
or opinion through RTI application and all such applications can be 
summarily rejected.


I will never advise one to take such a serious issue at the local level. 
those people drag the case as long as they can and later if they anticipate 
to fail in any argument, they will refer the case to higher authority. it 
adds only to dragging of the issue.


regarding guidelines, yes, all the authorities have guidelines. but as I 
said earlier, they are just draft guidelines and not binding ones. they are 
just suggestive and not imperative. no law insist the authorities to 
strictly follow them. please try to understand the meaning of a circular. it 
is just a letter circulated to many people or institutions. it may not be an 
order or notification. all circulars are not law.


in the meanwhile, shaik was taking the issue with the department. dear

Sazid I can understand your anxiety and the problem you would have suffered.
Due to this lack of awareness even among the people who are sitting on
the higher authorities.
But don’t get dishearten with these occurring witch are bound to
happens with us.
In this particular case I would advise you to take this grievance to
the appropriate place, either you can reach to the education
department based on your district it self or pursue this matter via
any NGO who would be active in disability field.
There can be other mechanism as well but I don’t think they will be
feasible in your case, meaning filing an RTI or dragging concern
officials to the court of law.
Apart from it you can file an online complaint form over HRD ministry site.
But it would be better to take this issue step by step, I mean first
of all on local level itself and then if not redress then Higher
authorities.
Here I would also like to clarify that there are appropriate guideline
for the extra time provided for VH candidate in all examinations
whether it is academic or competitive exams.
UGC, Banks, Education departments etc. everybody have now proper
directions through circulars to insure mentioned extra time duration.
The thing is that you should obtain those circulars,
And for the benefit of your and others most of the required circulars
related with the visually challenge are available on
