Title: Special Radio Broadcast To Raise Money For Hurricane Victims





Tonight (Wednesday) at 8pm, there will be a special radio broadcast airing on three stations simultaneously to raise money for the Hurricane relief efforts. Over thirty New Jersey musicians have created special recordings just for the show. Artists involved include Republic (Brian Saint  the Sinners), Jon Caspi, Ken Shane, Maybe Pete, Tommy Anton, Bruce Tunkel, Arlan Feiles, Thomas Martin, Amsterdam and more.

The show will be broadcast on Blowupradio.com, UpstageRadio.com, and 90.5 The Night. Listeners donating $25 or more will receive a free Upstage Radio t-shirt if donated online at:

What is going on at City Hall is totally different from the Wonder Bar. The 
Wonder Bar is in regards to the hurricane effort. City hall Press Conference is

Beach Club. His father is the supervisor of public works here in A.P.
So with DADDY'S political connections he was employed as an A.P.F.D
dispatcher.

The use of eminent domain has always involved a delicate balance
between public benefit and property rights. Through a series of
Supreme Court decisions, that balance has tipped away from property
rights, and the once-clear definition of public benefit has been
gradually broadened to suit the interests of municipal governments and
powerful developers.

Eminent domain is leaving an increasingly bitter taste upon the
American tongue as more homeowners see their rights trampled. It is
imperative that we act to protect our communities and keep this power
from being abused for private gain.

Eminent domain is appropriate when used fairly, responsibly and as a
last resort. Before invoking this power, there must be a good-faith
attempt at negotiating the sale of the properties in question.
Homeowners must be justly compensated. Most importantly, the land
should be used in a way that undeniably benefits the community, such
as the construction of a road, bridge or school.

The U.S. Supreme Court's recent ruling in Kelo vs. New London has
blown the doors open for further abuse of homeowners' rights, making
the need for state-level regulation of eminent domain usage obvious
and urgent.

We request that our colleagues in the Legislature support a bill we
have introduced to protect homeowners. Assembly bill 4392 will ensure
eminent domain is reserved for situations that adhere to its original
intent.

Our bill would prohibit the use of eminent domain for the acquisition
of residential and commercial properties that are legally occupied and
maintained in accordance with applicable codes and standards. Under
this bill, no families would see their perfectly inhabitable homes
demolished for the construction of private office buildings,
mega-stores or shopping centers.

Eminent domain is still used today in some cases for the same reasons
it was written into the constitution. Municipal governments invoke it
to build roads, schools, access to utilities and, in general, to
improve their residents' quality of life. These projects have
undeniable benefit and value to communities, meeting the standard for
eminent domain usage, and largely justifying the inconvenience they
create.

With Kelo vs. New London, the Supreme Court changed the standard test
for the appropriate use of eminent domain from whether the property
will be taken for public use to whether the taking of the property
would benefit the public. The court's vague and dubious phrasing has
gutted the ethical standard that has historically checked the power of
eminent domain.

An economic project that generates revenue and creates jobs fits the
new definition of public use, because these benefits will
theoretically pass to the entire community.

There is no longer any legal distinction between urban-renewal plans
that create great private reward and, for example, the construction of
a public utility. A modest neighborhood could be declared blighted and
replaced by condominiums or commercial property because those projects
might generate higher tax revenues.

If the standard for eminent domain is whether the local government can
make more tax revenue from the existing property or from a new
development, in most cases the new development would prevail. It is
fundamentally unfair to evict homeowners for someone else's private
gain. This practice understandably causes people to lose faith in
government.

The problems inherent in eminent domain are only exacerbated by the
broad discretion the Supreme Court has given in its application.
Expropriation does not create public property, as the land (and the
lion's share of any benefit) is often turned over to a different
private owner. As it is, municipalities often fail to truly engage in
good-faith negotiation, and court rulings rarely provide satisfactory
compensation to the evicted residents. After all, there is no
financial appraisal for the hardship of losing one's home, especially
one that has been inhabited by a family for generations.

Economically disadvantaged communities and communities of color are
most often the victims of eminent domain abuse. Few can afford the
legal battle for their homes. With the standard for eminent domain
loosened, the battle seems like a futile one.

The silver lining in Kelo is the window the ruling left open for
states to regulate the specific conditions of eminent domain use.
Already, legislators in 12 states have introduced legislation that
narrows the definition of public use in an effort to eliminate private
property being taken for private use.

Eminent domain remains a necessary tool for communities, but our bill
creates a necessary and vital restriction on the concept of public use
to ensure this government power is applied responsibly and appropriately.

Hello folks. I'll fill you in on the Big Announcement at City Hall 
this morning.  That press conference was followed up by a similar 
one in Trenton.

You can probably catch it on News 12 New Jersey tonight and in most 
of the State's papers tomorrow. There was a great deal of press at 
both conferences.

Here is the deal, but I want you to know first this is not a 
partisan event; I'm hoping it becomes multi-partisan so everyone of 
every political persuasion and independents will want to involve 
themselves in it:

New Jersey gives out Homeland Security money to the various towns in 
New Jersey. Obviously they are supposed to spread it out according 
to need.  There is millions of dollars at issue.

Asbury Park applied for a mere $200,000.00 of these funds. After 
all, our entire eastern border is one of America's vulnerable spots 
(the ocean) and our police force is currently understaffed.  We are 
subject to storms and flooding.  As we all know from the past weeks, 
local government must be prepared to deal with calamities because 
the Federal government is not the first responder to disasters. We 
are.

Of course you can guess how much Asbury Park was awarded:  $0.00.  
Not even a phone call was made to tell us either.

The situation gets worse.  The 11th Legislative District is 25 towns 
from Atlantic Highlands down to Brielle, almost all of them on the 
Shore.  Well, those towns together were awarded $0.00 in Homeland 
Security Funds.

Just north of us in the 12th District, check out some of these 
numbers:  Freehold was awarded $157,000.00; Manalapan was awarded 
$187,000; Marlboro was awarded $196,000.  I'm not begrudging these 
towns getting the money, but it makes no sense that the Shore towns 
get nothing.

Why did this happen?  I have to talk about parties here for a 
moment, but I promise I will get right off it because I won't let 
this get partisan.  The Democrats have the Governor's chair and the 
legislature.  If you look at what happened statewide:  90% OF THE 
MONEY WENT TO DEMOCRAT DISTRICTS; 10% TO REPUBLICAN DISTRICTS  
The 11th is a Republican District so Asbury Park and the other 24 
towns got $0.00 (Freehold Manalapan and Marlboro are in the Democrat 
controlled 12th).

The Press Conferences I had today in AP and Trenton was attended by 
the AP Fire and Police Departments as well as Democrat and 
Republican elected officials from around the 11th District.  Here is 
the plan:

I am suing the Governor and the Attorney General seeking an 
injunction from turning over the money, to give all the towns a 
chance to have the funds reallocated.

I am going to employ the services of Drinker, Biddle and Reath, one 
of New Jersey's top law firms regarding public financing (they 
successfully sued a prior administration over a funding issue and 
prevailed).

As all of you know, Justice is open to the public like the Ritz 
Carlton is open to the public.  It costs money.  The last time 
Drinker Biddle sued the state the fees were approximately 
$100,000.00.  Therefore, that is my fundraising target.

The purpose of both press conferences today was to request donations 
for this lawsuit.  I am seeking the help of people of all political 
persuasions to donate, as this is not a partisan endeavor.  If you 
think AP should share in the Homeland Security money, then I hope 
you will donate.  I realize Asbury Park has several Katrina 
fundraising efforts going on now, but I hope you will make some 
allowance for your own Homeland Security needs by donating to this 
fund.

Simply speechless!

I'm glad I didn't take off a half day's work to see the spectacle of 
a lawyer suing to cut more pork off of a useless bureaucracy that's 
quickly bleeding the government coffers dry. I'll gladly give back 
my family's share of the $187,000 given to my town if they agree 
that I AM NOT a threat to the nation and agree to stop the damn 
random searches of me, my wife, and my kids.  

You're right. This is not a partisan event. When the government is 
handing out money like a degenerate gambler on a bender, it's every 
persons God-given right to hold their hand out and loot or carry 
away as much as they possibly can.

I'm ashamed BB. How you can call yourself the Conservative Voice of 
Asbury Park while standing in line with everyone else at the 
printing press is completely beyond me. Your penance is to read Not 
Yours to Give by Davy Crockett each night before bed.

Why don't you sue our city council and Asbury Partners? The REAL money 
we should have gotten for our assets would be more than the entire 
state had to split up. Its more like Homeland Insecurity if you ask 
me. The money should go to the places of real threat, major cities, 
nuclear reactor sites, water supplies, etc. Backshit, ND gets more per 
capitia than place like NYC, JC, etc.

Why don't do speak out on the real issues that affect your neighbors? 
You need go no further than the boardwalk and Asbury Partners' offices.

You have the nerve to caution Skip about going to small claims court 
over the Deal Lake boat landing?
