RE: PROPOSED LEGISLATION ON EMINENT DOMAIN; LETTER DATED: SEPTEMBER 
13, 2005.

In an article by Bill Bowman and published in the ASBURY PARK PRESS 
on Wednesday October 5, 2005; the results of a recent poll by 
MONMOUTH UNIVERSITY and the GANNETT NEW JERSEY newspapers on eminent 
domain shows seventy-six (76) percent think that private developers 
benefit the most.  The overwhelming majority of New Jersey residents 
believe that the power of eminent domain is being abused.

Seventy-five percent (75%) of those polled also said there should be 
a moratorium on the use of eminent domain until solid guidelines can 
be developed.

Also, seventy-five percent (75%) said property owners do not receive 
a fair price for their property.

The sum of One Thousand Dollars ($1,000.00) that you propose in your 
legislation for relocation is arbitrary and capricious.

There is no fair market value compensation, and certainly not when 
people's lives should be taken into consideration.  The only 
acceptable formula would be Profit Potential Value to the highest 
bidder.

The words for public good are a vague representation that has been 
abused.  

Public Works projects should be the only acceptable use for using the 
power of eminent domain by any governing body.

Eminent Domain legislation should be just as definitive as a 
municipal zoning use ordinance.  That is, permitted uses should be 
clearly defined so that it would not be

necessary for the Supreme Court to interpret and decide what should 
or should not be permitted.

The seller sets the selling price of property, never the buyer.  But 
in the case of eminent domain, this practice is reversed which is 
unconstitutional, and denies the civil right of free trade in a 
democracy.

If the above recommendations are followed, the referendum that you 
propose in your legislation would not be required.

On what survey or public opinion are you basing this legislation?

ENCOURAGE THE ACTING GOVERNOR TO IMPOSE A MORATORIUM ON EMINENT 
DOMAIN IMMEDIATELY.

STOP EMINENT DOMAIN ABUSE!

In 35 years, I don't remember that corner, ever being totally empty, 
except in a hard blowing rain, or a blizzard and since I have to pass 
that corner from time to time, it's disgraceful, that parents have to 
be intimidated, if they speak out. It's really sad, that so much 
effort, is being spent on redevelopment, of the boardwalk, when 
you've 
had an epidemic, right on that corner. When youths have to resort to 
selling drugs, rather than working at a regular job, there's 
something wrong, with the system. The rationale, is why work 
for$5.25, 
when you can rake in, as much as the market will bear? Funny thing, 
is 
you seldom see a patrol car, there. I'm not condoning the sale or use 
of illegal drugs, just wondering, how the system failed these kids. I 
read that the school board had to cut back on programs. Why is Asbury 
Park, with all of its' problems, shortchanged? When the education 
budgets of other districts seem to be making it, why isn't Asbury 
Park? Doesn't the Board, employ an Attorney? If so, what does the 
Attorney do? Who makes up the budget? Why isn't this district, up to 
stuff? Not blaming the board, just wondering! Why can't Asbury Park 
keep a high school principal? Why are saleries, for Principals and 
Superintendant, so high? I remember when the President of the United 
states only received, $200,000 a year? Is it me? Does anybody know? I 
know that minority children, are suffering, from a lack of caring, no 
trade schools, to steer under-employed youth, etc. I don't see the 
military, as a way to avoid poverty, with this endless war going on. 
The rich, send the poor to fight wars, they themselves wouldn't suit 
up 
for, wear flag lapel pins and call themselves Patriots and when you 
disagree with them, YOU become a threat and to them, a terrorist, 
just 
for disagreeing. There's a whole lot of desk-hawks out there, so keep 
on supporting, whatever it is you support. You strap a uniform on 
poor 
black and white youths, cheer them on to the front and when they come 
back in body bags, or lame for life, you avert your gaze away from 
them, so no, the military, is not the way. These kids, can learn how 
to be electricians, plumber's, carpenters, chefs, or any myriad of 
alternate professions. Whatever hapened to that Jobs program that the 
council wrote a resolution for? Swept under the rug? I don't read or 
hear anything about it, so do citizens have to hold their feet to the 
fire? Inquiring minds want to know! Where's that UEZ money? Isn't 
that what it's for? Jim Keady is only one person but he IS making a 
difference! Too bad, others don't see our children as the prioity 
they ARE! Asbury Park will continue to have the BAD rep, they've 
carried, at the expense of other kids, who DO make it! I KNOW that 
Asbury Park kids, are good kids. Some, just make bad decisions, that 
make the whole town look bad!

Don't you know that the council only tells you what you want to hear? After 
35 yrs you should know that.Like you said , all they are concerned about is the 
redevelopment, and what goes on elsewhere doesn't matter. They don't care if 
those kids sell drugs. They'll just jail them and put them to work in the 
federal pen,so they can have cheap labor and fulfill contracts for whatever the 
gov or state wants. You've seen them on the circle doing gardening and whatever 
else. It's all a game. As far as the youth goes, some of them fell the 
recreation will make a difference. Not always. They need constructive programs. 
Stop teaching that old educational crap , and teach them something that will 
help them to better their condition. Why teach them things that won't benefit 
them in the work field later in life. They should ask these children what they 
would like to learn and make that a part of the educational system. Instead of 
the history of people who aren't their ancestors, unless they want to be 
historians. Please give us a break and teach them the real history of this 
planet,and not just blacks came here as slaves. Tell them the real history of 
their royal roots.They have to know who they are to know where they are

   Theatre exists to show the good and bad of

   It's our pathway from the past to the present

   Theatre tries to do this at a price that people
 can afford.  
  Sometimes it
   may seem expensive, but when compared to what a
 normal business 
  would have
   to charge to make a profit (or just survive) it
 is a bargain.  
 But 
  that
   bargain comes with a price.  It means tons of
 fundraising, 
 begging 
  everyone
   from single subscribers to giant corporations to
 the government.
   
   And the government plays the smallest role of

   Subsidization may sound awful, but it happens in

   do people feel bad about the poor farmer who's
 got a decision 
  about selling
   the family farm for a couple of million dollars
 to a developer

  wants to
   put up a shopping mall but they hate the fact
 that artists are 
  being helped?

   Maybe the problem is that America shoots for the
 lowest common 
  denominator.
   We despise our European roots because they still
 believe in 
 things 
  like art
culture as defining a society.  We fail to
 understand how there 
  could be
   Muslims who are so offended by what we call art
 these days that 
  they want
   our society to be wiped out.  To MOST OF THE
 WORLD, arts  
 culture 
  is how
   they want to be remembered.  I guess Americans
 would rather be 
  remembered
   for how well their stock did today.  We don't
 think of legacies 
 or 
  legends;
   heroes or people who changed the world.  We
 think of immediate
   gratification.
   
   August Wilson passed away yesterday.  In some
 places around the 
  world, I
   expect there is a significant loss being felt. 
 It's a shame that 
  99% of the
   people in America have no idea who Wilson was. 
 And that's why 
 the 
  arts
   should be subsidized in my opinion.  Because men
 like August 
  Wilson have
   done so much for society that people SHOULD know

think that the issue of EMMINENT (not imminent, tho it
IS!) is VERY MUCH an issue relevant to Asbury Park and
the abuses of 'the law' going on there against the
'common folk' and property owners, as well as many
other places in this country, under the very elusive
banner of 'public good' and have seen several good,
informed posts on this issue on the site, and would
again thank some of the folks/groups posting them for
keeping me up to date on their activities.  But hey,

 stuff? Not blaming the board, just wondering! Why can't Asbury Park 
 keep a high school principal? Why are saleries, for Principals and 
 Superintendant, so high? I remember when the President of the United 
 states only received, $200,000 a year? Is it me? Does anybody know? I 
 know that minority children, are suffering, from a lack of caring, no 
 trade schools, to steer under-employed youth, etc. I don't see the 
 military, as a way to avoid poverty, with this endless war going on. 
 The rich, send the poor to fight wars, they themselves wouldn't suit 
 up 
 for, wear flag lapel pins and call themselves Patriots and when you 
 disagree with them, YOU become a threat and to them, a terrorist, 
 just 
 for disagreeing. There's a whole lot of desk-hawks out there, so keep 
 on supporting, whatever it is you support. You strap a uniform on 
 poor 
 black and white youths, cheer them on to the front and when they come 
 back in body bags, or lame for life, you avert your gaze away from 
 them, so no, the military, is not the way. These kids, can learn how 
 to be electricians, plumber's, carpenters, chefs, or any myriad of 
 alternate professions. Whatever hapened to that Jobs program that the 
 council wrote a resolution for? Swept under the rug? I don't read or 
 hear anything about it, so do citizens have to hold their feet to the 
 fire? Inquiring minds want to know! Where's that UEZ money? Isn't 
 that what it's for? Jim Keady is only one person but he IS making a 
 difference! Too bad, others don't see our children as the prioity 
 they ARE! Asbury Park will continue to have the BAD rep, they've 
 carried, at the expense of other kids, who DO make it! I KNOW that 
 Asbury Park kids, are good kids. Some, just make bad decisions, that 
 make the whole town look bad!

  might be a better choice. Meanwhile Codey makes smart moves, seems

  of the people and for the people, and, to the naked eye, isn't a 
 scum 
  sucking corrupt thief like our last elected governor.

  Correction, if I may'structuring w/honest
PEOPLE...' I think would be more appropriate, and NOT
politicians, but caring and knowledgable folks from
the area might be better- much like a lot of the folks
that post here!!!  What 'POL' knows more about your
city and county's problems then YOU FOLK!! We just
need to get the caring folk into positions of
authority, and ones that ask for public consensus at
every turn!!  (Tho I DO concur w/a lot of your other
opinions!)   -al
