from today's APP letters to the editor: I saw your (APP) Jan. 4 editorial Field of Dreams on the proposed Little League field in Asbury Park. Have the organizers looked into Derek Jeter's foundation? It is called Turn 2 Foundation and its mission is to create and support signature programs and activities that motivate young people to turn away from drugs and alcohol and Turn 2' healthy lifestyles.They award grants and are particularly interested in assisting youngsters in inner cities and urban areas of America. Man dies following fight in Asbury Park Posted by the Asbury Park Press on 01/15/07 BY NICHOLAS CLUNN STAFF WRITER ASBURY PARK Police this morning were investigating the death of an unidentified man found unconscious by officers late last night, Sgt. Dexter Whitley said. The death occurred at Second and Ocean avenues after a fight, he said. Officers who responded to the scene found the man bloody and unresponsive, but Whitley would not say whether he died as a result of a homicide. The victim was later taken to Jersey Shore University Medical Center in Neptune. Whitley would not release the victim's name because his closest relatives were not yet notified of the death. Yahoo! Yeah, there were a ton of police down there. While unfortunate this one really wasn't the kind of issue the prior murders were. Seems like an isolated bar room fight that got out of hand rather than anything really reflective of Asbury Park, gangs, etc... Skinheads and Heavy Metal music are 2 completely different things. I sincerely doubt you'd ever find trouble with anybody in the metal world, but skinheads are a whole different animal. They are usually racist to the extreme, and use shows as recruiting grounds. There was once a great music venue in Trenton called City Gardens that basically had to close down because of skinhead related violence. Personally, I think Club Deep is making a big mistake by hosting events that are connected to skinheads in any way. I won;t go over old history. Needless to say, he contradicted what he said in a public meeting about the value of the Triangle only two weeks afterwards and took Partners side and disseminated untrue info about that deal in two newspapers. Later he renounced and contradicted what he said years earlier in print and radio about the height of any development on the C-8 site. The Democrats begged him to run for Assembly. He finally agreed. What happened next? The Democrats totally abandoned him. They gave him no money or support and hung him out there on his own. What a backstab! Now compare 2 years ago. The Dems ran two VERY politically connected guys on the State scene - Doherty and Reilly. The Democrats pumped in over One Million Dollars to their comapaign, more than 90% from out of the district (they still lost). If John is thinking about running, he ought to turn to our friend on this Board Michael Brim and tell him this time he wants the money pledged first. Let Brim take that to Scudiery and Cryan and tell them that's what it will take to get John. However, John is an honorable guy. I suspect he wouldn't want to take part in all that wheeling of money from other places like Doherty and Reilly did. It is a disgraceful practice, and one the Monmouth Dems use to a disgraceful extent. They've been challenged to run elections with an agreement not to wheel money, which the Republicans agree to do, but the Democrats turn it down every time. Law enforcement authorities say it is difficult to draw a direct connection between the decrease in gun-related arrests on the roadway and the spike in gun violence in cities such as Newark. Some feel it is not that big a stretch. There is no way a reasonable person could not connect the dots between what's going on the highway and what's going in these communities,'' David Jones, president of the State Troopers Fraternal Association, told the newspaper. These are not separate circumstances.'' The decline is attributed to a change in state police strategy on roadside searches, spurred by a state investigation into the practice of pulling over cars and making random searches for weapons. The 1999 probe found that troopers were stopping drivers based on their skin color. State police were put under federal oversight and forced to change their tactics. The numbers went down because we ended the program of random interdiction as a law enforcement tool,'' said former Attorney General John Farmer, who helped institute the reforms. The tactic had seen some success, but when weighed against the alienation of the minority community, it was not effective, and law enforcement had to get better.'' Since the racial profiling controversy, state police have focused more on working with police in cities such as Newark, Irvington and Camden where smugglers transport guns in large numbers. Last year, authorities in those cities seized 114 firearms, up from 86 in 2005. I think though they stopped the practice of random stops at check- points. I believe it is constitutional to have a check point with a pre-determined number: Stop every 7th car, or every 8th car, etc. I think they did away with that. And the legal minds on this board might also answer the question: were the original restrictions or covenants legally binding 100 years ago or now? Would a Bradley decendant actually have any say in the matter? And by the way, how long is perpetuity nowadays? Just until you reach room temperature is my guess. the first set of street lamps are up near north beach. they look just like the ones in the pictures most of us saw a while back. they look mighty good in my oppion. im sure everyone else will post their thoughts as they see them for themselves. the waterfront blocks are going to look pretty good once they all have lights like this on them. the area will look like no other beach front town in the area, thats for sure. i cant think of any other town that has souly only these types of lights, without the taller cobra lights. even long branch has a mix of both. charlie Yahoo! Frank, You are dragging up an old debate we have had here a few times. Some on this board believe that Bradley, in his benevolence, inexpensively deeded the beachfront to the City because he wanted the people to use it forever. Others, myself included, believe the mean old cuss had to have the beachfront ripped away from him in a lawsuit by the City, he received a good negotiated sum for it and that he never wanted the people to use it forever (despite what he once wrote on top of the 1903 map). I've been promising myself to get down to Freehold to research the lawsuit in more detail. Someday. As to Liquor licenses, Bradley kept this City dry. I don't think he allowed any, and they came into play in Asbury after Bradley lost control (if I'm recalling correctly). Regarding perpetuities, that is the big joke in law school, trying to make sense of the Rule Against Perpetuities. It has something to do with deed restrictions expiring after a human gestation period, a life and 21 years, but the whole thing gets confused by a fertile octogenarian (I'm not making any of this up). Needles to say, the Rule Against Perpetuities question is the one on the bar exam everyone skips because they know they are going to get it wrong anyway. In simpler terms, perpetuity, which means always, doesn't always mean forever (I know - laws are terrible when not clear). There are many ways to break a restriction, even one deeming itself in perpetuity. It has to be legal in the first place. I could put in the deed of my house that it shall never be owned by a Democrat, and if it is, it reverts back to me. Unfortunately, being a Democrat is still legal ;-) Seriously, you can imagine there used to be color restrictions in deeds that are certainly not legal today. Regarding Asbury Park's Beachfront, the matter was already litigated in 1989 when they vacated part of Ocean Avenue. The Appellate Division found that the City was not bound by any covenant to hold the beachfront open for public use. Note too in 1988 the Trustee of Bradley's Estate released all claims regarding violations, reverters, etc, to the City. That was noted in the Court's decision. The Bradley heirs no longer have a claim to enforce anything to the beachfront. Notwithstanding what you cite, the covenant has to be specified to run with the land. However, you would be surprised what in fact has been deemed to be binding after many, many years. Yeah, I hear some local attorney has power of attorney for agroup of them and signs things away over the years williynilly. Sounds Fishy to me. Baker Jun. 3--FORT WORTH -- State District Court Judge Don Cosby this week lifted several century-old deed restrictions on land near the bustling Cultural District, among them one that banned any of the current property owners from selling alcohol. Acme Brick, JaGee Properties and several other landowners along West Seventh Street and University Drive sued the heirs of the stockholders of K.M. Van Zandt Land Co., which was started by one of city's pioneer families. The landowners argued that efforts to revitalize the stretch were being held back by antiquated deed covenants. Cosby signed a final order lifting the deed restrictions Tuesday, clearing the way for Acme Brick, which owns 12 acres along West Seventh Street, and JaGee properties, which plans a 10-acre mixed-use urban village in the Cultural District, to either redevelop or sell their properties with a clear title. In talking to folks who are interested in buying our property on West Seventh Street, we wanted to make sure the title is clean, said Dennis Knautz, Acme Brick's chief operating officer. The company has its headquarters on the site but plans to move to southwest Fort Worth. Kimco Montgomery Plaza, the Dallas-based group redeveloping the former Montgomery Ward property, reached an out-of- court settlement with the more than 100 heirs in April, agreeing to pay $222,000 to remove the deed covenants. The Montgomery Ward building includes tenants that wanted to sell alcohol. Deed restrictions dictate how property can be used. They are often transferred with the land when it is sold. Although such covenants are routinely overturned, they remain in force unless the new buyer goes to the trouble, and the expense, removing them. For example, one of the deed restrictions in this case dictated that if there was a violation, the land reverted back to the original owners. But in arguing that the deed restrictions should be tossed out, Acme and others argued that the original owners, and their legal representatives, no longer exist. The Van Zandt land company was dissolved in 1947. They noted that from 1945 to 1991 at least 17 separate judgments had been issued by local courts invalidating the restrictions on other Van Zandt deeds. Nick Acuff, the attorney appointed by the court to represent any of the Van Zandt land company's unknown heirs, said that he will appeal Cosby's ruling but that several of his clients are talking about settling with Acme, JaGee and the other landowners involved in the lawsuit: the MPA Foundation, Garview Partners, Nona Inc., Spokane Ventures, Whitehead Equities and Will Ed Wadley.
